I have a question for everyone who works outside the home. This question is mainly for the US employees. Isn't it against the law to be fired if you have a doctors note, and or used against your personal record? My daughter had a kidney stone problem and was in the emergency room Saturday morning from 2:30am to almost 7am. She was suppose to go to work that day but the doctor gave her a note to stay home for at least two days. She was off on Sunday and Monday Thank God. She went back to work today still in pain because there are more kidney stones on the left side. She gave her boss all the paperwork and the doctors note to show her it was all legit. She says ok but one more occurence and you will be dismissed. Can you believe a company like JC Penney's would treat their employees so bad. If you accidently sign out one minute earlier then you are suppose to, its considered early dismal which is used against you. Well JC Penney's hasn't fired my daughter yet but they have definitely lost me as a customer.

Has for being against the law to be fired after being sick and having a doctor's note, that all depends on the circumstances and the employer. Some employers don't care if it was a legitimate reason or not, you are given so many days that you can miss. However, under the circumstances you have stated, it shouldn't have affected her work status. She was told to stay home for two days, which just happen to be her two days off. So I'm not sure why it was even brought up at work. Also, I have to ask, had she already missed some days at work, 'one more occurance and you will be dismissed'? There are so many ways that employers can get around the laws on firing someone, that in most cases it isn't even worth fighting it, the employee won't win.

I beleive the last time she was sick was last year so there was no reason for JC Penney's to treat her this way. You are right the employer will always win on a case like this because they know the ins and outs of getting their way and wining. This is the main reason I don't trust big companies and their policies.

I don't think they can fire her for being sick but sounds like they may have it in for her & if that's the case they'll find some excuse. I think that people who work for large companies like that are just a number anymore. They don't have much compassion for people. Hope everything works out for her.

That is what has happened with the big companies. There is no security at all and like you say you are only a number and there is no compassion for the employee. There is no longer any type of loyalty from the employer. Thanks and have a nice day.

I don't know if it's legal but it certainly isn't fair. Your daughter can't help that she got sick. Did she call in before she went to the ER, or let them know she would be off work? I think there is something disallowing a company to fire someone because they are sick but I'm not sure. A big company like Penney's should have the resources to compensate when someone misses work.

That's VERY unreasonable!! If I were you I would look up the labor laws of your state and see if your daughter is protected in some way. I remember years ago I was in an accident and after surgery I was at home recovering. My boss said she couldn't hold my job forever so I went back before I was supposed to. That was in the 80's. I would think things would have changed by now!

I believe its different in every state and job. If this had happened in New York she would have been excused because she had a doctors note. However JCPenneys is very cheap and really don't care about the employee at all. Its a sad state of affairs for employees these days.

She was due to work at 12 noon on Saturday. She didn't get out of the emergency room till 7 in the morning and the doctor had said to take a couple of day off and rest. When she left the hospital she called her job telling them what happened and that should wouldn't be able to come in that afternoon. They said ok. She was scheduled to be off Sunday and Monday already. When she returned to work on Tuesday with a doctor's note and all the other papers proving what the problem was (kidney stones)she was told another incident and you will be dismissed. So she can't take another day off for nothing till after September. I told her now what if I was to god forbid to die would they then dimiss you because you couldn't come to work??? What kills me about all this is they don't even get medical, they can take vacation but they don't get paid for it. She only gets paid 8.55 an hour to deal with alot of rude customers on the phone. Remember the customer is always right. So no matter how nasty the customer is she has to be nice. I really thought working for JCPenney would have been a nice job but after all the stories of have heard from my daughter I wouldn't want to work there for nothing, and now I will never shop there ever again.

That's a horrible way to treat an employee and I intend to stop doing business with J C Penney, too. Might even shoot them an email letting them know why, too. I live in Florida, which is a Right to Work state. That means that you can be terminated for any...or no reason. I don't know what the labor laws are in your state but you might want to check them out just incase.

Hi Lelin. If I was in your daughters shoes I would talk to the main manager of the store and tell them what was said and what had happened. By law she will have them by the nuts if they fire her with a good attorney she can have what she deserves. And believe me if someone talked to me like that I would be at an attorneys office the next day I had off. We that live in the USA have rights and we are able to enforce these rights. Tell your daughter to keep records of any and everything that goes on about her. And anything in the past that has been said or done to her for no real good reason. I hope and pray your daughter is feeling better and will be on the road to better health soon. God bless you and yours.

Well since I posted this discussion my daughter quit the job. She couldn't take it anymore. She felt like it was a no win situation in the way she was being treated. I had told her it was against the law to let someone go due to illness especially with hospital and doctors notes and papers. However, it seems JC Penneys has their own rules that I guess are above the law. I was a loyal customer for years and so they lost us both not to mention others who responded to this discussion and other family members.

Hi Lelin. I hate people like the one that worked with your daughter. Seems like that person was over stepping the boundaries of employee relationship. I never shopped at JC penny's cause of the way I had been treated there once. I don't like going to a store where they don't respect their own employee's. Good luck and God bless you and yours.

Call centers are like that. They have no mercy for their employees whether they are sick or not, abused or what. What they want are robots who don't get sick and robots who will do everything without any feelings, without getting hurt or what. I think it is what many companies lack today. They lace compassion for their employees. They like to think that their workers are not humans. That is why I never want to work for any of these companies. They rob you of your dignity and self-worth.

Hi, Lelin. Most of the company right now really try to "save" as much as you can. They can change their policy anytime they want. Like the department store also doing that clocking out earlier as a tardiness. These days clocking in and out no longer do that card punching. We have to do it through their computer networking. And it need employee ID and password to do it. Everything seem have to be "on time" computer just calculate you as tardy if you not coming in or clocking out earlier.

That's why it's pretty suck! Believe it or not they almost fired me last year for that "tardiness" or what I call it stupid technically reason. They said according to the system I have more than 7 tardiness. Well, I told them that i have to pick my kids in the daycare. I scheduled until 6pm, and the day care closed at the same time, and I need 15 minutes window to drive over there so I don't get late fee per kids.

Penalizing someone for accidently clocking out one minute earlier is stupidty on the companies part as far as I'm concerned. Her watch said it was 5:00pm and I guess the clock to clock out said 4:59 - are you kidding me. That is taking it to extreme to me. However they don't reward you if you are there half an hour or 15 minutes early do they, NO - but that minute you are considered early dismissal.

For most companies it's about profit. Gone are the days of valuing an employee. It is a shame. having worked in a call center environment for most of my career, either on the phone or as an assistant supervisor I can tell you, that call centers have high turnover rates. They hire and fire often. One big reason I am glad after 18 years, I gave it up.

Yes its a shame what the companies have become. They don't care one bit about their employees at all. Employers don't understand that the kinder you are the better an employee will work and be happy which will prevent high turnover rates. Thanks and have a nice day.

I don't know what the law says about this, but I do know you can fire someone who cannot do their job and she has been given a warning so it may be within the law for them to fire her. If you look at this from the employer's point of view you can see that they cannot run their business without employees who report to work as agreed upon. It's not like school where a Doctor's note can get you off. Business doesn't run like that and since most buiness is already running very short handed they may have to find someone else to do her job, there are certianly enough people who would want that job. I know this is cold, but that is the way business runs. I hope she will be well enough to keep her job. Good Luck

Its not like she can't do her job. She couldn't come in for a 4 hour shift due to being up all night in the emergency room with kidney stones. The doctor also told her not to go to work for two days. Thankfully she had the next two days off. This is a very bad way to run a business as big as JC Penneys is and that is why people don't stay their because JCPenny's does not know how to treat its employees. The turnover is crazy at the call center. Thanks have a nice day.

Hi lelin! I have worked outside the home and in a call center, as a matter of fact. I haven't worked in several years and I hope you don't mind me saying anything but I don't think this is right. No, I can't believe a company like Penney's would do this, either, and I've always liked their merchandise. I shop from them whenever I need pantyhose. Anyway, getting back to your daughter's problem, they need to be more considerate of the employee's feelings. What if the boss is sick? Will they let her go, too, even if she had a written note from the doctor? I never have worked for a company like this and it doesn't make sense to me. Kathy.

No it makes not a bit of sense. If its a medical reason they can't fire you. At least that is the way it was for me when I worked in New York. It doesn't make a bit of sense to me either. Thanks for your response.

you can sue the company if your daughter gets dismissed. it should be waived or excused if its because of medical reason, since its not the employee's fault. File a complaint with the labor department if that happens. Good luck.
