Photographer and equipment detained at Virginia Tech

I regularly read the blog at http://www.photoattorney.com/, which is written by Carolyn Wright. She was kind enough to post a notification she got about a student at VT. The student photographer was documenting the tragedy with his camera. Police detained him, and confiscated his gear. While he has been released, they have not returned his gear. Now, I don't want to take away from the VT tragedy in any way, but I hope people take note that this is a blatant violation of search & seizure, and is totally illegal. Can you imagine what FOX or NBC would have done if their photographers had been detained and the gear illegally taken from them? I'd love to hear what others think about this.
