to sue or not to sue:Nestle Fruit Selections Yogurt with a SCREW.

my brother bought a Nestle Fruit Selections Yogurt in a drugstore. when he got home, he opened it and found a large screw almost 2" in diameter.
he called nestle hotline but it was not available for some reason. i, his sister, emailed nestle and they called a day after. they told me they would get the yogurt with the foreign body and they will replace the product.
i have questions going on. is it enough that they replace the product? we have been trusting nestle for years. my daughter's milk is Nan 2Ha, we eat cococrunch, nescafe, etc. and obviously, that trust was somewhat marred.
some people tells me to sue. some tells me to just let it go. some people tells me to go ahead, give the specimen and take the replacement and dont demand for anything because of values. what should i do?

Well I am curious, as to what grounds you will be sueing on if you do decide to sue. First of all, I believe it will have to be your brother who sues since he is the one that bought the product and found the screw in it. Secondly, why would someone want to sue for that, I mean were there any injuries? Did someone take a bite and then find the screw? Were there any teeth injured? From your post, it didn't sound like there were any injuries or trauma so I don't understand what you or your brother could sue for. Thanks for sharing your story, take care and have a great day. =)

first of all, the screw might have been filthy or dirty, which is not a very good characteristic of "food", and in turn, not a very good characteristic of a quality service. the screw could have been rusty (ferric oxide, i guess). i think some amounts of it could be toxic to the body. some other kinds of filth might have been present like oil or grease, if it came from a machine, and other unknown substances, which might be harmful to the human body. this is a form of adulteration of food.
if a screw was there, I, as a common people, a regular and faithful consumer of nestle would be very disappointed of how they assure and secure the quality of their food products. this is called exemplary damages.
i am his sister. of course i could speak in behalf of him. well, yes, technically, he, hypothetically, could sue. but, in reality, of course, since we are siblings, we are together, if, and only if he decides to sue.

You are correct, the screw could have been dirty but if you read up on today's news, there are so many new recalls almost everyday for the very foods that many of us eat. It seems as if there is less and less that is actually safe for us, I wonder how many people will sue all the places who have recalls. If sueing with the complaint of alteration of food I wonder if it has to be an act of purposely atlering the food. As for the examplary damages, are you really that distraught over this to sue for those type of damages..just curious. I would certainly be distraught if it were something like a human finger, but a screw, naw, I guess I would just let the company know so that they can investigate it and be done with it. Whatever your decision may be...good luck, I wish you the best. =)

yes. i am certainly distraught. any foreign material in my food, that i did not intentionally put in, i would certainly be worried. however small it could be or whatever it is, it is not supposed to be there. the law states that too. of course, they should investigate it. i would want an explanation.
if nestle's quality control bypassed this foreign matter, i guess i have the grounds to say that it might happen again. we know that they have one of the strictest quality assurance and control in the world.

Really? I can't imagine this happening to Nestle products. Of course, we can't deny that they are one of the leading brands in the Philippines today. They have an array of products in the market. This must be alarming. We really need to be extra careful.
