How could this "Doctor" be acquitted??? Don't you think he should have been put away the first time for a very long prison term, his licence permanently revoked? What is going on with our legal system?? Va. Doctor Convicted of Drug Trafficking ALEXANDRIA, Va. (AP) - A pain-management doctor who prescribed large amounts of opiates and drew patients from across the country to his northern Virginia clinic has been convicted on 16 counts of drug trafficking by a federal jury. Numerous patients had prescriptions for hundreds of pills a day, and one had a prescription for 1,600 pills a day. Several of his former patients testified against him, and prosecutors played tapes of conversations in which Hurwitz seemed to know that his patients were selling their prescriptions. The jury ACQUITTED William E. Hurwitz on 17 other counts on Friday, and a judge DISMISSED 17 others, including the most serious charge - drug trafficking resulting in death. ***It was the second time in three years that a federal jury convicted Hurwitz of drug trafficking. His 2004 conviction - and 25-year prison sentence - was tossed out by a federal appeals court, which ruled that a judge improperly barred the jury from considering whether Hurwitz was acting in good faith.*** Prosecutors argued that Hurwitz was no better than a common drug dealer who ignored obvious signs that his patients were dealers or addicts. Numerous patients had prescriptions for hundreds of pills a day, and one had a prescription for 1,600 pills a day. Several of his former patients testified against him, and prosecutors played tapes of conversations in which Hurwitz seemed to know that his patients were selling their prescriptions. Hurwitz, whose high-profile advocacy of high-dose opioid treatment once landed him on "60 Minutes," has been scrutinized by authorities for decades, and has had his medical license suspended twice, in 1991 and 1996. ***Between 1998 and 2002, Hurwitz drew more than 400 patients from 39 states to his clinic in McLean. Prosecutors said the waiting room was frequently occupied by STONED or sleeping patients with track marks on their arms.*** Numerous physician and patient advocacy groups supported Hurwitz, and said his case should be dealt with by state medical boards rather than criminal courts. So sad he wasn't put out of business the first time around, and what amazes me even more is people acually go to him. It just proves that some people will sink to their lowest levels given the opportunity. Sad that humanity has to be this way, makes you wonder how we survived. I also wonder why the pharamacies were allowing this to happen...they should be able to stop excessive prescription filling too. I think they have a responsibility here too. There has to be a way to stop this kind of thing before it gets out of hand. I hope this triggers some kind of regulatory legislation and allows it to be enforced.

I do not understand how advocacy groups can support this man. He may have some valid points about large doses of pain meds for certain illnessess and conditions, but he is causing pain and abuse throughout by his lillicit and illegal acts. What are these judges thinking?

I have to assume that you have never been in constant intractable pain. Before you get ready to roast anyone on a spit, remember that there were many of his patients who were legitimate. I have to take powerful pain medications everyday to avoid the crushing, burning, writhing pain that waits for me if I don't. Let's hope the legal system doesn't get so confident that people like me are left to our intractable pain with no hope of relief.

It just goes to show that the law system needs to be overhauled big time, so people like this will be put in the right place, and never be able to do something like this. All they did basically is give him a slap on the wrist and told him not to do it again. I would assume that he made a large amount of money doing this, and that lure will always be there tempting him to do it again.

I find the actions of this so-cslled dr shocking! I do beleive that drs should be compassionate and stand up for their patients and they should be supported on doing so! People with chronic pain need help and support but to me it seems as though this guy just wanted to make money and didn't care what he had to do to make it!
