Money incidentally deposited into your account. Can you spend the money?

Let's just say the bank had made a mistake and deposited a lot of money into your account. What will you do? Is it legal for you to use the money?

As you said it was a mistake and you have no right to spend something which is not yours even if it's in your own account. In banks there is such thing as paper trail and it would always be determined that it was a mistake and adjustments has to be made. It is certainly not legal nor moral for you to use that money because bottomline, it is never yours and you haven't earned it in the first place. Happy postings!

Of course not by right. But by laws, will it consider as stealing? Or maybe the laws will be different in different countries?

For me it is tantamount to stealing because in PRINCIPLE it is not yours to spend or take.

everyone had said it already or most of you. Its not your money so dont spend it. WHen you do and the bank finds out it was accidentally placed in your account, they will still take the same amount deposited and what happens then? You will be broke im sure since you thought you will be spending THAT money but at the end you have spent yours.

I know. But the bank should at least take some responsibilities if it was their fault. They had just made some clients felt miserable and confuse ;) I say the bank should let go the money and of course deposit the same ammount to the correct owner.

I think it might end you up with problems if you spend it and they request it back. But from what i've heard, sometimes if you let them know they have made a mistake they might credit you with money for being honest and then it would be your money. I personally wouldn't spend the money because my freind had this problem when he was in college and then they requested it back immediatly and tried to charge him intrest for not being able to pay up immediatly. It almost went to court and eventually they had to let him off because it was their mistake. It was ALOT of hassle though.

I guess different countries will have different rules. But maybe the real question is will you feel safe if the bank did this kind of mistake?

If someone by mistake deposited it into your account, I believe you should inform the bank. But if the bank made the mistake, I guess just enjoy it man :)

If the money is in my account then its mine lol i will certainly use it and if ever the bank realise that it was a mistake... i would say i am not at fault; i thought the money was mine!!! I would go for shopping and buy me max of clothes, shoes ohhhh that would be like a dream come true.... What about you?

At least you are very honest :) I don't think I will have gut to spend the money although I agree with you it was a bank fault.

nope, it's not right to spend the money. it's not yours anyway. even if you keep quite about it, the bank will eventually find out and say if you have used a portion of the money, then you'd be in bigger trouble, as you need to pay the balance hehe.

Definitely it's not ours and we should not have spend it. But the bank should have not us to pay back because it was their fault all along. In fact, I think the bank should be fined. It's the lesson for them :)

I would not say anything at first just to see if the bank will correct its mistake and take the money out of my account. If a week has gone by and the money is still there, I would call the bank and inquire about this unknown deposit. I would not spend the money at all because I wouldn't want nothing legal to backfire on me. I wouldn't want to play with somebody's money because I wouldn't want someone to do that with my money if it has been placed into somebody's account accidentally.

for me, i dont want to spend of it because its not my money and if i will spend that money maybe they will ask me to pay that after, so its better not to spend it.
