Taking advantage of affirmative action

The college application process has always been heated. With many universities practicing affirmative action, it has become even more contested. Many students are taking advantage of affirmative action and marking down ethnicities that are in high demand by schools. My step-brother is trying to get into law school. He is only 1/16th Native American, but he is going to mark it down anyway. Do you think this is ethical?
