Should that person be held more accountable? For instance since that person chose to go out and drink and drive then they wreck, destroy property or kill someone should that be classified as premeditated? In my opinion it should be, because no one twisted their arm to get them to drink and drive. And they chose to do something illegal. So what is your opinion on this??

Yes it's premeditated. Everyone knows drinking impares, you have to be a complete idiot not to know this. Anyone stupid enough get behind the wheel of a car after having a few drinks, is making the choice to hurt themselves and/or someone else, it's just pure dumb luck if they don't. No excuse for it, none! The laws should be stiffer on this and charging premeditated sounds just fine to me.

Well the man that killed the pedestrian that i was talking about was charged with vehicular homicide and was given 6 years probation. How is THAT severley punished? As far as the abortion comment....i am going to that discussion right now.....;)

I believe that abortion is murder. Because that when someone has an abortion they are KILLING another human being. Have you ever seen photos of aborted babies?? Also did you know that there are babies that are aborted that could live if an abortionist had not drilled a hole in their heads and pulled the babies brains out?? And yes they do that, abortion is not only murder but it is barbararic (sp) in my opinion. If someone does not want their baby for whatever reason they should at the least put that baby up for a doption because their are people who would love and raise that babies that they chose to kill thru abortion. Abortion is premeditated murder.

No it should not be considered pre meditated , They should be held accountable for vehicular homicide or whatever the judge deems. It would not be premeditated unless they planned to get drunk and then go kill someone.

Is it pre meditated if they get behind the wheel with a cell phone held up to their ear and hit someone and do damage to them. Is that pre meditated. What if they are drinking a soda and they slam into someone or hit someone on a bike, is that premeditated?

Premedittated or not, it is illegal. When the pedestrian that I have talked about(who was my father) was killed, the man the ran over him was given 6 years probation. If he violated that, he would serve time in prison. A month after his conviction, he was charged with a DUI in a neighboring county. After that he fled to another state, when they finally caught him, he ended up serving about a year and a half in prison. Then when he gets out, he says he didn't do it. He was taking the blame for someone else.
