Who Should Pay For The Cheque Return Charges?

My husband issue a cheque dated 21/12/2006 for the deposit of our car - Toyota Rush. On 10/6/2007 we received a called from car dealer claims that the cheque that my husband issue is "bounce", want my husband re-issue a cheque for them. In the same time, we received a letter from bank there is S$50 charge for return cheque.
I was so angry, called to the car dealer to clarify with them. WHO SHOULD PAY FOR THE CHEQUE RETURN CHARGES? They apologize says that is their clerk mistake due to the clerk overlook the cheque. Since is their clerk overlook, they should bear for it. The person in-charge agree. I inform him that I'll re-issue a cheque with S$50 deducted, he accept.
Today, I meet the salesman (he is my husband's friend) he told me they deduct S$50 from his commission.
I feel so sorry to him, is very unfair deduct his commission due to the clerk overlook. They should deduct the clerk salary.
