please advice me on what to do..i am filing charges of attempted murder against my brother for still threatening m life..i am now going to local government for support..and for the girlfriend she is threatening the whole family to expose the whole family..she disrespect my mother and now i had enough of her..she is in Denmark and will get back here on October..do you think i can file charges against her words of threatening my family when she gets back? if so, then what would be the case? please i need legal support anf advices here..help me friends

You sound so desperate. Whats up? It is normal for siblings to quarrel but threatening one's life has exceeded the boundary. It is no longer normal if someone in the family is taking the law into his own hand. Talk over things and settle amicable, if that cannot be solved then you have no other choice but settle it in a family court.

yeah sibling quarrel is normal but what happened to me is not normal..he just beat me up 2 days from now..he tried killing me by suffocating me and and hitting me over and over again..he throw me on the walls and bang my head on the wall..that is not normal..now his girlfriend is bugging me sending me text messages she will gonna do everything to ruined the whole family

OK I hope you don't mind if I put your case with my suggestion this way.
Before your lodge to police station you must have the 'prove of attempts'. Do you have any proven texts for this? I mean the texts such as e-mail, sms,.....etc., any such prove that likes for her attemptable?.
If you got those documents, then you can proceed lodging police report as K.I.V status. This is the precaution step for your family as anything bad happen to your family after she touched down back to your country, she will be the first suspect.
Must do something good in protecting your family members. Wish you all the best and good luck.

ok Michael, i have here the text messages he had been sending me..i did not delete what i got from her since the last consecutive days..i did not delete it for his reason..i will be doing your suggestion..if i may ask..would a sister testimony over this can help strengthen the case?

First and foremost, you have to discuss with any police personnel that closed to you and if it happen he/she is your relative make the case much better.
Discuss your case with that police personnel to make certain of at what 'degree' of that case. For sure he/she will leads you the way.
No need for you to find any attorney or any lawyer firms as it maybe thinning your wallet. In any law case, police who will handle at any particular case and next come the lawyer....are you agree with this statement. If you agree.....go to the next paragraph.
K.I.V. report means your intention to take a first step of precaution in furtherance to lodge report when the expected event happening in future. And the K.I.V. file will be opened and regarded as 'lodging report' if the victim maybe no have time to attend to the police station to lodge report on after that event has happened, due to many reasons and one of it is for one's safe guarding/protection.
MY CONCLUSION;
go for discussion with police personal at the nearest police station because this 'homicide' case is a serious case that will be happened if lack of scrutiny.

I'm sad for you. :( Your brother sounds like a bad person and I am sorry that you are the one suffering. I pray that everything works out!
Criminal threatening is also a charge which may apply but you did the right thing filing a report.

Hi there. Go seek out proffessional help, if you cant afford it, ask for a legal aid or a court aid to give advise, actually you can also ring and ask for the citizens advice bereau... Remember do not delete your messages, as they are your hard evidence, law will take more notice hopefully... Good luck with this one...

I feel bad for you because the fight is not with an outsider but with your own brother. I can understand what you are going through. As everybody else here told, I too would suggest you to make a police complain and take their help. Don't try to do it yourself. They can handle better. Hope you can find a solution soon. Why do you always solve the things lonely,you can ask for help from your friends,and they will protect you also,you can live in your friends' house,and your brother can do nothing for you ,I don't think he can attack you when there is a lot of friends or person arround you,and you also can ask a policeman to protect you all the time and I think the police should solve it as soon as possible.

I would suggest u that threatening of life itself is a great and single leading clause which can be sufficent enough to file case against her,also several other clauses which can be included as mentioned above like moral damages,u can also ask for recuperation of money which ur gonna spend in fighting the case,also i wud request u to ask for local government for your personal security for you as well as your concerned members.

threatening itself is a very dangerous idea to begin with because he may not do it but what if someone did the pleasure for him then he will gonna be in hell lot of trouble don't he? i am so fed up with him so be it..this is the fight he started then i will finish the pleasure for him to get into the bars.

Hi personally i have had family issues with my half brothers . like you they threatened to kill me and all that crap some of it were empty threats some were real. i have personally talked to friends on police matters they have ben through and my self what i have experienced with new york law is that when it comes to threats , police cant do much without any physical acts. on the on other hand they usally would give a warning for threats but since u have text and other proof then perhaps he could be arrested for some minor charges. At the end of the day you have do what ever you think is Necessary to preserve you and your families well being. i hope this helps.

You need to consult with an attorney in your country who is well versed in the law where you reside. Frankly, I hope that all things will resolve on their own. There is no reason for families to be so vicious towards each other. Whatever happened couldn't be bad enough for people to threaten family members.

I don't know about the girlfriend but I do think a good start in your case would be to file a restraining order on your brother and then proceed to press charges for attempted murder. I understand that he is your brother and this makes it hard for you but I have been following your story and if ever there is a case for tough love...it is yours.
