Do some phones just have really bad software? And if so, what can i do about it?

I have bought a Nokia 6280 this xmas, and trouble begun slow, but steady. First pictures went missing, then games failed to load with error, then when playing music the mobile just froze with the screen all white and "booted" like a computer... as if i closed and opened it! Then when someone called for more than 1 minute it did that same as for playing music, except after it reopened it never showed me who called, and the person was still callong, but it showed me nothing.
So i took it in service, because it is guaranteed to work for 2 years at least, and they formatted it, and it worked untill i made a film in top resolution mode, then it froze and "booted", They reformatted it, and i did the same, and it shut down without opening again. So i leaved it to the service to fix it. They said "this model has software problems" like that was supposed to make me feel better about coming with them with a small problem, and landing into a whole different level of s**t.. They gave me a spare phone to use, a sagem my x 5 2, and that irritated me too, because it doesn't even begin to compare to the phone i had... and they said if they cannot repair my phone they will give me a new one, if they have one or give me my money back...
Since i bought my phone with a "new subscription" discount, i think it's only fair they let me buy a new phone with this discount.
What do you think about this?

phone softwares/hardwares maybe buggy or
become buggy. For softwares it is a good
practice to update if there is a new version
available as this fixes some fo those bugs.
For hardwares, a chosen few can fix it.
