Help please!

Hello, everyone! I am writing this to help ease the burden that I am feeling right now. I have a big problem, and I really need advice, especially legal. I have rented this place for my foodcart and canteen business, and I signed a one year contract for the unit. The owner let me pay a 2 months advance and 2 months deposit for the said unit, that amounts to Php40,000 total. Now, on the second week of my stay in the said unit I decided to cancel my contract since I gained no profit at all from the business. I just want to stop so as to refrain from more loss. The problem now is, the owner of the unit doesn't want to give my money back, at least the remaining money that was not used. Since I was only able to use 2 weeks of the 4 month period, I expected 3 months of that money back. But they wouldn't give it back. I am so confused and so sad. It was a lot of money for someone like me to lose. My question is, do I have the right to demand my money back from them? If I bring it to court, if ever, would I possibly win? Please advice me on this. Thanks.

Sorry to know that you are in this kind of mess. Anyway, you signed a one year contract, so I believe it would be really hard to get your money back. The way I understand it, you actually even have to pay the rent for one whole year because of that contract. But then, I am not a lawyer. Ask for a lawyer's advice. He/she might find a loophole in your contract. Good luck!

Do I really have to pay the rent for one whole year? Oh, I hope not. I have cancelled the contract for valid reasons and if I have to pay for it then L'd better use it than pay for it for nothing at all. 40t is already a big loss for me. Paying for one whole year is so much bigger I can never afford it.

Im sorry..But if you can find something wrong with the unit.Then you might be able to get your money back.Read your contract again an see if you can find any flaws in the contract also..make sure they kept up their end of the contract.If they didnt, then i would take them to court.You might be able to win your money back.That is alot of money just to give to someone.Just ask yourself some question,like did the bathroom work? did the unit leak when it rain.did they tell you that they would fix something an didnt..i sure wish you luck on getting your money back.

Thanks for the response. Actually, the bathroom faucet and the kitchen faucet in the sink don't work fine at all. There's almost no water coming from it. And the door shutters, they are so heavy for my salesladies to open and they always have to ask help from passersby to open it because it is defective. That is one reason why I have to give up. Oh, I sure hope I'd get my money back.

Carefully read over the contract you signed when you moved in. Take it to a lawyer and get his take on it. Whether you can go to court and win will be determined by what you agreed to in the contract.
