Smoking in public places?

So I was going back after walking my girlfriend home and had to wait for a tram.. It was raining, so I stood under the tram stop, and there were two people smoking. Now, I don't smoke, to be honest - I hate cigarettes. And there is a rule that says you can smoke in public places here in Poland - but nobody cares and police isn't doing anything about it. I don't care about their lungs - if they want to get lung cancer, sure, why not. God, I even wish them to die soon. But why do they have to affect my health as well? I don't smoke, and yet I have to smell it in most of the places :/ Why is that nobody cares whether they do something bad to others or not? Do you think smoking should be punished better by law? So that you get reward for a bigger sum that will cause you think twice about smoking next time?
