I wish Canadian laws were more like the Americans

In a nut shell, intruders break into a couples home, the man gets into an altercation with them, and one intruder ends up dead, the other in the hospital, and get this, they're thinking of charging the homeowner with murder. How is this right? I believe that if someone comes into my home with who knows what intention of stealing from me, killing me or my family, or whatever, he's made a choice, and I will defend my family and my property from that. If that means the guy is dead, so be it, I wouldn't lose any sleep. The Canadian law says I have the right to use the MINIMUM amount of force necessary to defend myself. Well, how would I know that at the time??? It's crazy.

I believe if I am correct the law says you can use whatever means nessacery on your property here. But I know Canadians have much better health care laws.

No, it says you can use the "minimum amount of force". I for one don't know what that is.

Well to give the police some credit they do have to investigate the situation. What if the man did use too much force. For example, what if the intruder was fleeing and the man in the house ran after him and stabbed him 10 times?!?! We don't know the circumstances. Besides, it said that the police are still determining whether or not it was self defense or manslaughter. Its their job to investigate. I'm sure that the person will not be charged if it was self defense.

If an intruder comes into my house, I'm not going to stop and think what is "too much force". It's not the police I find fault with, their hands are tied, it's the justice system that needs a serious overhaul.

This is horrible and frightening but fact of the matter is it's not any better in America - the laws covering this are from state to state. Now, I live in Michigan and our law reads pretty much the same as it sound yours does. But, I lived in Texas for 10 years and there it's totally different and basically even if their outside your home shoot first, drag the body in the house, then call the police and there will be no problem for the home owner.
