Breach of contract what does this suppose to mean?

I was a little upset with my telephone bill yesterday knowing that I still have a balanced when in fact I am prompt in paying my bills. I even paid early without receiving the notice of my bill for the month. The problem with me is that I lose some of my receipts and that I cannot contest to them anymore. And so I had decided to let my connection be cut-off but to my dismay it wasn't a success for I need to pay 7thousand pesos penalty for breached of contract for I had signed a 1 year contract with them. My friend what is this breached of contract mean? Is there a remedy of this one. LOL! Please help me with this my friends.

LOL when u get the connection there might be clause that u have to keep it minumum for one year. this must be part of contract, and there might be penality on discontinuing of the connection. so as u decide to cut it off, so u voilate the terms of contact So in simple Breach of contract mean voilating the conditions written in contract and make in invalid Solution to ur problem continue ur connection till date u have agreed in contract Take care

Hey Sheen, Its long since I saw your discussion, hope you have been well. About breaching of contract, I am not really into law but I think it came about because you signed a 1 year contract and you are not allowed to revoke it till the year ends. There is a fine when you revoke the contract before the year ends hence breaching of contract. Oh my I dont know any bit of law. I just used layman language. There are lawyers in here and they might help you.

yeah kwenge it's been 3 mos. I think since i haven't log in this site. But I doing very well, thanks. Do you know one? I know no lawyer, you know if you ask a lawyer it needs money and I don't have that. Maybe you could help me and refer my problem. My only intention on deciding to cut-off my account is for my bills not to increase some more. As of jan. 17 when I inquire my balance it is only 1005 pesos (phil. money) and just this evening I inquire again it is already 2,147. What a quick increase what do you think? The problem with me is that I lose some of my receipts. I got only few with me.

I don't know any lawyer in here, maybe they show themselves up to advice you accordingly. I could advice you to go to the company premises and request a copy of the receipts you don't have or a statement of account to compare the figures. That amount looks weird for that period of time. Have you tried to check maybe someone somewhere is busy taping your phone hence the hike of the bill? I saw an instance where a neighbour used to tap the others phone.

Breach of contract means that you in some way shape or form did not meet your obligations to fulfill your contract. Per their records you missed payment, so you broke (breached) the contract. The only resolution her is to find all receipts, canceled checks or any proof of payment that shows that you did in fact pay every amount owed.

yeah that's what i intend to do. The reason why i am thinking of cancelling the contract is to prevent my bills from increasing and as of now I already got a past due. I'm afraid i will not be able to pay for it if this contract continues. And this unpaid due is all I have to worry. What If I won't pay for the penalty? what would it cost me? What are my obligations?

If you totally cancel out there is probably a fee that you will have top pay on top of whatever they say you owe. I have heard of charges up top $400 for canceling a phone contract.

hi sheen! ^__^ breach of contract means you didn't follow everything that was written in the contract that both you and the telephone company signed. for sure when you applied for a telephone line, you signed many documents and that includes a contract. the moment you signed the contract was the moment you agreed to all the terms and conditions and that probably include a 1-yr period that you have to use the phone and pay the bills. if you didn't follow that, then you are in trouble my friend. ^__^;; you shouldn't have lose those receipts! receipts are very important. but if you have receipts, then surely they have a record in their computer of your payment. unless, your receipts are not computer generated. .

Breach of contract is breaking from the terms & conditions stated in it, like you must patronize their services for one year, up to date payment. Go back to the office where you made payments because for sure it is in their computer, only maybe they had not sent it to the main office-like Manila. I experienced delayed reporting by the office. I requested a cut-off internet services because we couldn't access it anymore, the service is too slow. I returned all the items required but on the next bill, I was still charged with it. I went to the office where I returned the items, presented my receipts/documents and the personnel apologized because she had not reported the returned items. Maybe, this case is similar to yours. However, you must develop keeping records because you cannot contest the personnel if you have nothing to present to them.
