madden 09 and the new england patriots

i heard people talking about how in madden 09, the patriots should not be allowed to be used in online play. the argument is that, too many players on that team will likely receive high ratings and the team itself will be unfairly rated much higher than every other team. do you think a) it is fair to keep the patriots in online play and b) if this ban could ever be in place?
