A trademark is something that a company takes out on their product so that nobody else can use the name for it. A trademark protects a name, symbol, motto or an emblem that identifies a product, service, or a company that has legally protected these things. A name can be trademarked: (example: Vicks Vapo Rub) Vicks is the name of the company, it is also a brand name. Vapo Rub is the product, and it also has a trademark so that nobody else can use that name for their product. So, in effect, the Brand (Vicks) can be trademarked, and the product (Vicks vapo rub) can also be trademarked. A trademark is basically a protection from identity theft of the name of the product, or the company that is selling the product. Chances are good that Vicks company has their logo trademarked, the name of their product, and the name of their company too. Vicks would still be the brand name, whether it is trademarked or not.

Brand stands for name of company. Such as Sony, Nokia, Phillips, etc. trade mark is not a name of a company. It is a special mark or symbol which uses the manufacturing companies for their product. Always the Trade marks are copy right protected and these play an important role to introduce the product in a market.

A brand name would be Bounty paper Towels. There are many different brands of peper towels and Bounty is just one of them.A trademark would be The golden arches of McDonalds. The Golden Arches are owned by McDonalds. It is their symbol or logo.I hope this helps.
