well mylot i have another problem. here is my situation
At the end of Marchin my closet the carpet began to get wet everytime the water runs. so i called my landlord and left a message telling her that i thought the water pipes were leaking. the maintaince guy came and busted a hole in the wall and busted the water pipes.
As a result of this i have lost valuable things that i can not get back, cloths and electronics because the maintaince guy didnt do the simple thing and turn the water off befor he began to try to repair the problem. we had to get 7 gallons of water up from the floor in the closet and throw away alot of things.
due to all the water we have black mold, and mildew all over the closet and the smell is all through the house.
today is 04/15/2008 and the maintaince guy finally shows back up and place a piece of dry wall tacked over the hole he created.
I have been forced to call the health department, because my land lord will not call me back regarding my loses. I have called her everyday leaving her messages trying to get this problem resolved. She told me to hold the rent until this problem is fixed. What would you do?
I need some advice, I am waiting on another apartment complex to call me back regarding my application. We are trying to miove out of here, because everytime we need to call the landlord she is unavailable. Now i have a note to leave the premises, but i still have the rent.
Mylot help!!
What would you do in this situation?
Would you pay your rent any way? hold it?
Would you take them to court?
I need your advice mylot!!

I would calll the health dept and anyone else i could call to tell them whats happening to you...I would not pay the rent ...I would take a note of everything i lost and sue them,take them to court and save all the information,dates and take it to court....They cannot throw you out or make you leave the primises because they will not fix things..Get the health department involved and fight this,they cannot do this to you...You have a loss ther of clothing,electronic's ,and you have suffered a loss and they have to pay for your loses...Unless you just let it slide, and if i were you i would fight this all the way to court...Yes take them to court but make sure you have all your dates,your phione calls ,her responses and your loses.....Just because they own the place they cannot do you this way..I am sure they are treating the other tenants the same way...There is also a fair housing dept,take pictures and fight this girl you can win this...

I would have had the housing authority and the health department in my place as soon as the hole was made. You should check out the renters laws in your area because you probably just can move out at this point with nothing happening to you legally.
You need to keep of list of when you called her, uif you left a message etc. You also need to send her a certified letter.

Now that you've involved the health department, you should have no trouble with the landlord. The notice to leave the premises is really nothing to worry about, you don't have to panic usually until you get the court notice, which will take about three months. You in particular don't have to worry about that either, because you have a legitimate reason why you didn't pay. It would have been better had you taken the rent money to escrow, but since the health department is involved, the landlord doesn't really have a leg to stand on.
