I have a hearing coming up very soon, my ex-job is appealing my Unemployment benifits and I have to go and I am alone and have no clue what to do or say, I don't think I was wrong to be fired but that can't be my only defense.
long story short:
customer was mad over film not done, she called me a racial name to my manager, when she walked away I said to my manager that the customer was acting psycotic and the customer went crazy screaming, cops came, she called me a fat slob, the manager did nothing, she actually left me alone to be yelled at by this woman. the cops came and escorted her out, she went to another store to have her film done, that manager gave her the district managers personal email address and here I am fired!
help people, does anyone know what I can do!??

Chazsgirl, you need to mention your work history there such as "I worked for 'x company' for 7 years. I had good attendance and good work ethic. Although, I got fired, I don't believe I should have. For example, the customer was being uncoroperative, calling me racial names. None of the managers were assisting her or me. I told me manager I was upset with him/her and that the customer was a physco. I thought the customer left and I didn't say it very loud for the customer to hear me. Obviously she heard what I said and it made her angier. My manager called the police because the woman was out of control. The police made a statement about the woman, and for some reason the woman asked for our corporate number. She made a corporate dispute and I was fired. However I think the firing was unjust because the woman was having a bad day, calling me names, and my manager didn't come to the asistance. Now it was me who got fired. Therefore, I think my job should either re-hire me as an employee or give me unemployement benefits."
I would also recommend bring in a copy of the police statement, a copy of the corporate email appeal (if you can get ahold of that), your manager, the police officer (if no report was made), and the crazy customer all to prove your case.

Wow, thanks for the best response. Yes, you really should because if you were good worker then there shouldn't be a reason to fire you or they should give you unemployment benefits just like everyone else :)

I have been to a couple of them but mine we all over the phone ones, but they are really not that hard, you just have to tell them your opinion and go from there, this is very touchy when it comes to racial remarks and if the customer heard you say something like you did your boss would of had to fire you then because the thing is the customer is always right no matter where you are working that is just how it is..Whether she calls you a name or not...I would just explain it the best that you can and go from there good luck, but since the cops were called that could almost save your unemployment for your manager should not of left you when the customer was angry and standing there screaming at you, she should of taken charge that is her responsibility..so that could help you.

Chaz, who called the police? Was there a report written up. your manager had to give the corporate phone number and or email address. there was nothing else to be done about that. She asked it had to be given. Can you get the managers support on this issue and what specifically did your termination slip say? What are the laws in your state?

Don't worry about it. I was there once. I had quit and then was layed off from my full time job shortly after because it was indeed a seasonal position. I didn't win, but I tried. Just go try and get another job in the mean time as soon as you can. Sounds like you have a better chance. I think you do have a case. I have to wonder if there was a camera there. If so I bet the film won't be available. But You do have your side. Good Luck and remember there will be other jobs and this indeed will fade into the distance over time. God Blesses!

I wish I could think that way but I was there for 7yrs. that's a long time to just throw someone away like a piece of trash!

Your right that is a long time to "just throw someone away". I hope things went well and I hope you share how things went. Whether it was "Your preferred way or not". I do know NOW is not a good time to be in need of funds, or on unemployement at all. Either way may God Bless YOU and Yours in this very tough time. God Blesses!

That is crazy that all this has happened. Although, I can relate. At my old job I got yelled at quite often and the manager wouldn't even come if the customer asked for them. Was this the only incident like this that occurred? I would definitely be quick to point that out. Also, you might want to speak about your job performance, attendance, etc. If you were fired then there should be no problem here. The only thing that concerns me is that the cops were involved. Did they take a statement? You might want to take a trip down to the police department and get a copy of the statement (it might cost you like $5). If there was no statement (which would be unusual) try to track down the officers that were there and have them write a statement of what they remember from the incident. Come prepared with that and also your own statement written out. This will show that you are responsible and prepared.

if im not mistaken i think you are in titled to have someone represnt you its part of the unemployment you have to ask for a listing, they should be able to help you and it seems like your manager covered his/her butt instead.
