The Landord lost my rent checks

I had such a wonderful day yesterday and now this; the blasted landlord lost my checks. We have only had this new landlord since December and nobody in the building likes him. He has already lied to us and got everyone riled up. He has said the tenants wanted to convert to condos and we did not, so that bid to convert did not go through. He tried to throw a tenant out who has lived in the building for 23 years and he lost that too. He refused to fix the man's plumbing next door and told him if he didn't like it to move out. Now we all get a notice in our mailbox, that his briefcase was stolen and all his checks were in it. I went to the bank today in the pouring rain. There is no bus route to get there, so I had to walk. It nearly killed me, the walk was way too far. But it is not finished there. I closed out the account because I was not about to pay stop payments every month. I opened a new account but now I have to find a way to get to the welfare office to have my direct deposit for my disability check sent to the new account. It is so much work. I came home in pain, and now I probably will not be able to walk for 2 weeks because of this extra walking today. I am going to have to pay 32.00 for new checks as well. I am so angry with this jerk. Do you have any bad landlord stories?

Whoa, wait a minute. He lost the checks and YOU have to replace them? I don't think so! You gave him a check for the rent in good faith. What happens after that should be his responsibility. If he can prove that the check isn't negotiated after a specified amount of time, I imagine he could ask for another one, but to make you take time out of your day and jump through all those hoops for something he did is not right. You should not incur any fees for it either. I would not stop payment on a thing. If your check is cashed by someone other than who you wrote it out too, that is the bank's problem. They are obligated to check signatures, etc, and if they don't, it is their loss. You've done nothing wrong.

Yeah, unfortunately she has to replace the cheque. I know it sucks but the person who wrote the cheque will know if it was cashed or not. If it was not cashed she owes the rent. But you are right if the bank cashed the cheque and it was presented by a fraudster it is their problem.

by our law I have to give him another check and I closed my account nothing is to go through on that account now and nothing will. He will absorb the 32.00 fee I had to buy checks for the new account. My canceled check is my receipt of payment.

totally in agreement, Ldyjarhead - i think the entire complex needs to get together on this - i'm no legal buff - but i think a lot of people have a big inconvenience leg to stand on - maybe class action? Winterose - one key question i have is - do you get a receipt in person, or do you just drop the check in a box, and wait for one? if you have a receipt in hand - you are considered paid, unless the the landlord get notice of an NSF, as far as i know... i would still be concerned about that check out on a closed account - if it comes through, it is considered fraud - happened to me once by mistake - i'd moved, thought all checks had cleared, one little lagger was out, and i got a letter from the DA's office - NIGHTMARE!

In America we can change the direct deposit over the phone by call the Social Security 800 number. My aunt was recently telling me how her landlord passed away around Christmas time. They assume that the daughter has taken over. But she has never come around to see any of the tenants. When they mail the rent to the old house, they never get a rent reciept. Some of the tenants have stopped paying. But my aunt was advised to keep paying regardless, so she will not end up owing later on. She recently called me to get directions from the internet. She is going to go over and see if she can find out what is going on. They have called and left several messeges, but no one ever returns them. I am so sorry to hear what is going on with you landlord. It is very frustrating to have to deal with someone like that. Hopefully, he will clean up his act or move on soon.

Rozie37 tell your Aunt to put her rent in an escrow account until she finds out what is going on Actually all of the tenants can put their rent into 1 escrow account until they are notified about who is taking over. Tell her not to pay blindly she may still have to pay all that rent again if there isn't any proof. She can not get evicted for putting her rent into an escrow account

I had one who thought it was okay to come into my apartment whenever I wasn't home because he owned it, (he was checking to be sure it was clean, is what he had said he was doing in there)I changed the locks and he didn't ever come back in. He tried demanding a copy of the key and I told him he could have it after I moved out!

the law here is that a landlord can only enter your house in case of emergency like a fire or water is tripping into other apartments.

Wow! That sounds terrible. Well he should give you all a month's break (like you can pay him a month late) for his errors. He must not know too much about renting because he's required to fix plumbing problems otherwise actions can be taken against him. That sounds really terrible, and I am sometimes so glad I don't have any landlord at all. Pablo

Sounds like yours is bad enough.. This guy sounds like a horrible person and it would be just as easy on him to be nice.. It really would be easier for him to be nice, doesn't he have sense enough to know this?? I can sympathize about the problems with your legs, my husband has peripheral artery disease, I am sure that I spelled it wrong, but they call it PAD.. He has had five stents put in and they are closing up again and now the doctor wants to do bypass surgery on his legs, it is supposed to be much worse than bypass on your heart, so hubby said, no way, not yet.. We ran out of gas Sunday morning and had to walk almost a mile to the service station and a mile back, he has hurt so very bad since then and has had to take much more of the pain meds.. Could the tenants get together and have this jerk thrown out, there is no call for this type of going on with him.. He acts like he is just trying to make the tenants miserable on purpose.. I put a stop payment on a check quite awhile back, I had written it and about a year later it had not gone through, I have the account with which you get 2 free stop checks with it, so I used one but was told at the bank that if it ever did finally come through, then I had to make sure that I had the money to cover it or I would be charged a NSF fee.. Which sounded stupid because why would I pay, if it weren't free with the account, to put a stop on it if it could come through later and then have to pay a NSF fee.. But the point is even if you put a stop on it, the bank might do as I was told and then charge you a NSF fee.. You guys might need to talk to a lawyer and get this guy put out and get someone else in there to run the place.. Good luck. Take care and hope you get to feeling better soon..

I am sorry about this, Winter. When I was in Thailand I rented a unit with only a bedroom and a living room which I turned into a kitchen as well. I had to install the shower heater myself. I actually paid someone to do it. I had to clean the place before moving in and the dust was like accumulated for years. Whenever I wanted to talk to him, his agent would always come in between. He obviously didn't want to make any improvements in his unit. He just wanted to receive money and not spend a dime for his tenant yp feel comfortable living in his condo unit.

Things like this always happen to me. every time that something good happens for me, ten things go wrong right afterwards. I'm sorry he lost your checks. That caused you alot of problems. I hope you finally get it worked out with the bank and him though. I know it is very stressful for you. You shouldn't even have to be dealing with this at all. He needs to have a better system for receiving checks from his tenants. I don't have any bad landlord stories to tell. Renting was okay with us at the time.

a month later and it will only be finally rectified on tuesday, I was not able to walk to the disability office until last thursday so that meant they did not have enough time to change the bank info and so I did not get my check on thursday like everyone else. Because of that no money for the weekend, and I had to date the landlord's check for the 6th, just to make sure the money would be in the bank.

That is such a shame, winterose! How irresponsible can this guy be? I hope you keep good records in case you need to fall back on them. Maybe whoever is higher up than this guy will grow tired of his antics and get rid of him. I would pray for that to happen if I were in your shoes.

I w get a hold of an attorney and ask them about the housing laws in your area. He HAS to fix the plumbing or that person can put his rent into escrow to be held until the repairs are made. There should be a housing authority place in your area and you can ask them or look it up on the internet for housing laws. How many checks of your did he have that you had to close your account. I am thinking that it was more than one check. You should also look into having your rent directly deposited into his account and then he couldn't loose your check anymore. Did you get a reciept that it was paid?

It is not paid now because it is the May and June rent, that he has checks for. I have to replace the check, I know the laws in my area, and the man next door has to deal with his issues, he knows the laws too.

Yes, I do. You should read mine. I've never had a landlord as bad as yours, though. I am hoping I'll have a better experience at the new place I'm moving to; hope I'm not jumping out of the fryingpan and into the fire. I'm at my wit's end right now. Moving is hard enough, but try doing that, while workign two jobs and going to school at night to get your associate's degree... What a pain! Now, they wants us to paint the walls before we move. I don't think so! Just read my story... You'll get a kick out of it, I swear. I hope your situations eases up soon, and I hope you feel better.

I feel so sorry for you, and thank God i don't have a land lord , I think everyone in your building needs to rally together and get this guy put out!! there has to be someone higher up the chain that everyone can go to. This man sounds like he is holding a gurge because he didn't get what he wanted, so now he is going to try and make it tough on everyone. I will keep you in my prayers.

You are right anger on landlord this is landlord responsibility to save the check if you give it. This is the fault of landlord so no pay the money again. Ohhh you pay new check okkk means you have patience and understanding also. But why issue new check if landlord is telling lie then

Hi friend, sad to hear about your issue. I wonder why the land lord giving this kind of unwanted troubles to the tenants, if you are not comfortable with your house owner, you can change your houses, in my opinion it is far better than living with such kind of land lords.

Sweetie I am so sorry that your Landlord is such a jerk I have a lovely Landlord and have never had any Problems with him at all I do hope you will sort him out as I think he is a pain in the Butt and not good at all Why didn't you just cancel the Cheque as that is what I would have done

because of a breach of security, that check can now be counterfeited, printed, and used on my account over and over again. and I am not going through that. There was two months checks, and to put a stop payment I have to go down twice and have the money in the bank first and the whole reason I am angry is I had to go down the once crippled up in pain.

What a jerk is right! I hate landlords that are idiots--- Slumlord sounds more like it! I'm glad that he isn't winning things that he should not be- but what a pain to even have to go through them to begin with. So you cancelled your account instead of paying stop payments- I would have paid the stop payments and deducted them from the rent the next time- I mean that is crap- Why do you have to pay more for checks? You mean you ordered more checks and that was the cost?? Good luck getting your checks direct deposited into the new account-- should just take a phone call I hope! I own my home-- so I don't have any of these problems- I rented for about 5 years prior to buying this house- It was a pain- Most of the landlords were great. Just had 1 slumlord! He tried to hold my deposit-- He was a total butt. I fought him- I am much smarter than him-- won and he paid me- I did threaten him- that he wouldn't be dealing with me anymore- but my lawyer- I also told him that I wasn't putting up with it- and told him I was turning him in for being a slumlord!

stop payments means I have to go in person every month and that is too much on me to go to bank every month, and now that the check is out there it can be counterfeited, it is very easy to print up checks that look like the bank checks, they even have my signature. and now I can't do anything by phone, if I could I would have, and yes it is for the new checks because the old ones are no more good.

Rose, Had a landlord in Utah who sat the house on fire, with me, my kids, and the now "ex" were in it because I reported him for not properly taking care of the house. There was lead pain and a gas leak. He is now serving a few life sentences in Utah. Yes he was Mormon. Ainge

I am sorry that this happened to you... I am lucky in that my apartment manager and her son are great... I though did have one thing happen in the past which got me ticked... The kitchen faucet was dripping hot water and it took the maintence man a long time to come and fix it and because of it the electric bill went sky high. I still had to pay rent full pricea nnd for the electricity too. I thought it was unfair.

Callarse, Here's simple solution to having your disability checks to go to your new account. The bank should be able to do that for you. They will contact your case worker and the case worker will give the bank the info for the direct deposit. As for the Landlord, I would look up the number to your nearest Renter's Right's Advocacy agency, explain the situation to them and see what they can do to help you and the others in the building. no the bank does not contact anybody on the clients behalf, not here. I have to go to the disability people and tell them of the change of accounts. There is nothing they rental board can do in this situation, I know the law here, I just have to do it.

Bless your heart. I'm so sorry. I had an apartment manager in Texas who took off with all the cash residents had paid, plus the receipt book. She dumped the checks in a dumpster, since she couldn't cash them, then left town. We all had to prove we had paid rent. It was horrible. I hope you didn't do too much by having to walk that far.
