Would you call this a scam?

I was faithfully clicking at nocturnalmail.biz for the past month and finally made the payout of only one buck.
This is when I can't find the withdrawal button so I wrote to their support and recieve no reply. So today I re-read their TOS and found a NEW clause that states that non-US members cannot ask for monetary payouts, only advertising credits.
Wow, I am beside myself with surprise. That clause was not there a month ago! They have like the most comprehensive TOS in the whole WWW! So I am very sure I have not seen that clause when I started clicking.
Well, you see, my point is, there is no way I can prove that clause wasn't in there in the beginning. And now after a month, I can't claim what was promised to me and frankly I am reluctant to say I am scammed but I am scammed, am I not?

I wonder if there was something in the original TOS that said that they could change the TOS at any time? Chances are, there was a clause saying that. For me, I would drop out of this program unless you can use those points for prizes that you might actually like.
