It sucks, but yes it is true. Some states don't even require helmets while operating a motocycle, like Florida. But, North Carolina has passed that all helmets must be DOT approved by their saftey standards. I think it's good for those reckless drivers, but for those who do drive with caution and just want to cruise at night, it sucks for them.

I would get a Snell or DOT approved helmet no matter what. I wouldn't trust any helmet that isn't.
I know price might be a factor, but there are DOT approved helmets that are fairly cheap out there. I bought a scorpian helmet for only $200 and it is Snell and DOT approved.
