Unfair charges.

I've got a huge problem with my university at the moment! They have invoiced me with £265 worth of charges on books that i have already returned. I have told them that i gave them back on time but they maintain that they haven't got them so the charges stand. This has been an ongoing battle for several weeks but they have now stopped my access to the intranet system and this means i cannot enrol for next year, so it is effectively ending my career there and in the future in my chosen field. Obviously i am very upset about this, they have told me they will allow me to continue if i pay the fine, but i don't want to do so as i feel this is like admitting that i have kept the books when i actually gave them back and haven't done anything wrong, so why should i have to pay for their mistakes!? Have you ever been in a situation like this? What would you do, would you pay the money to keep the peace or would you fight them on it because of the principle? xxx

Oh No Munchkin this is not a pleasant situation at all is it but I would appeal and appeal again. I would also go and see all your tutors and explain and get them on your side too as this is just not fair if you have in fact returned the books. My daughter is at university herself and I know how she would feel over something like this. Keep taking it to higher people until this siuation is resolved in your favour. Thanks Ellie. I've been to my tutors and have got the course leader on the case, they are fighting my corner, telling them that i'm honest and reliable etc but there's only so much they can do! I'm going to the student's union tomorrow to see if they can help! I don't want to lose my career, i have worked too hard to get to do my training for that but i won't admit to stealing, which is basically what they are accusing me of! i'll keep you updated, thanks for your support! xxx

Hi Munchkin, I am really pleased that you have already got your tutors on your side. The students union is a great place to go and get help and advice and I am sure they will back you. If if accept this fine yes you are admitting that you have stolen the books which is incorrect so keep going until you win, YOU WILL WIN YEAH, you have all of us sending out positive thoughts for you on this one too. Aw thanks Ellie, that really means a lot, reading that actually made me cry, i've been so stressed out about this, it's lovely to know that you think i'm doing the right thing!!! I'm going to fight it until they admit they have made a mistake, my tutors have told me i have their full support and hopefully the union will be able to help me too! xxx

Who did you give the books back to? did you get a reciept? i definately wouldn't back down backing down for me now would be like admitting i'd made a mistake. I know how unis can be putting pressure on you as i had some issues with mine over my placement. You need to be true to yourself hun i think it's absolutely rediculous that they are stopping you enroling even the law states innocent until proven guilty. I would be speaking to your adviser and citizens advise and then if need be the newspaper and everyone else in a position of power that could help. I definately would not be backing down if they want to play the bullying game bring it on lets play i say!

That's fighting talk there girl!! thanks for the support! I haven't got the receipt anymore as i returned the books last december and didn't know there was a problem until i received the invoice in july, so i hadn't kept it! I remember it was a man i gave them so but apart from that not a lot as it was so long ago! I've seen my tutors and am going to the student union tomorrow, i've also just typed a very strong worded letter to the woman who my course leader has been speaking about it with on my behalf so hopefully i will get somewhere soon! I don't feel like i should back down as i know i haven't done anything wrong and they are basically accusing me of stealing them and i won't have anybody saying that about me, i would never do that!! Apart from that why should i pay for their mistake. The problem is that the way they are being at the moment if i don't pay them financially i'm going to end up paying them with my future career instead! xxx

Right now this really and truly is my last post!! thanks so much hun! They are saying they have no record of them being returned, there is obviously some error in the system somewhere, either that or someone is pinching their books - but it's certianly not me!!! I have a friend who's a lawyer too so i'll mention it to him when i see him on thursday but any advice you can give me will be greatly appreciated!! It's lovely to know i've got so much support here- you guys rock!! xxx

[i]HI Munchkin, That is very sad, how come they have no record that you return the said books? can you asked them to open their log books on the day you returned those books? I will be working hard to follow up so that they to check their list and will prove to them by any means! That is very unfair! Anyway, I haven't in that situation but I will not pay if that will happen to me especially when I am very sure that I returned it! I had a room mate who was also fined before but it was his fault since he didn't bother to return the books, his mom paid it all because the more it will accumulate since they are giving interest each week![/i]

I don't know why there is no record of me returning them, i can only assume there has been some sort of problem with the computer system! Fortunately they have now agreed to drop the fines and allow me to enrol again which is a huge relief!! Your friend was very lucky to have such a generous mum!! :-) xxx

That is totally awful. Is this like a library thing? If so then you probably have a library card to prove your return. If not, you're on the edge of a bureacratic system that won't budge. For all we know they may have just misplaced the friggin' books. I had this experience once when I tried to get my school clearance after school term ended. They didn't sign my clearance and was charging me an awful lot for unreturned books. What pissed me off really was I had to find where I placed my library cards stamped returned. It took me almost 3 weeks till I found it. I showed them the card marked returned, they said sorry, and I said big deal, next time I won't be too nice about this. Get your act together or some students won't get to finish school for your incompetence. Lol. I guess if I didn't find those cards, I would have been forced to pay for the books so I could continue my studies in the friggin' university. I have other ways to persuade really incompetent and even arrogant and bad people, but I use that as a last resort. Lol. cheers!!!

Haha fortunately i'm not going to need to ask what your last resort is as they have backed down and removed the charges as well as reinstating me at the university! I wrote a really good letter and had my tutors contact them on my behalf and they finally backed down! We don't have library cards, it's all done on computer so there is obviously a problem with the system, but it is strange they can't find the book,s but as i know i returned them i don't see why it's my problem!! I'm so relieved that all this is over, was beginning to think i'd have to pay them, and i wouldn't want to do that as that would be like admitting i was wrong - which i wasn't!! thanks for the response! xxx

Glad to hear that it worked out fine for you and that you have been reinstated in the university. You see, depending on a computer system without some hard copy proof of transaction or a receipt can be very unpleasant for people. If the system screws up, what would become of the people depending on that. Anyway, what is important is that you got thru with that deal. Cheers!!!

hey hiii munchin..!!! hope you are doing fine..and think you should fight either you should prove yourself that you have already paid the charges..or you need to fight as a student that they cant stop you to allow your system....cause you will be in a big problem as you wont be able to enrol for a year...!!! so just start fighting for it...and just try and try until you prove yourself... as you know " NO DEFEAT IS KNOW AS A DEFEAT UNTIL YOU QUIT..." wish this works out for you...munchkin....!!!

Well I suppose by now you must have had a word with the higher authorities. The disadvantage on your side is, the fact that you have no record of having the book returned to them , check if date of return is mentioned in your library card though . The only way you have, is to pay them off, but you can ask for netotiations. It is a fault from both sides. You can use the point, that even if you did not return at the right moment, you were not notified of that fact immediately. You can ask them to reduce that amount of money. Also, you can check if those book are available on amazon or somewhere else, for less price, that is, the used section, since the library books are used as well, so that way you might be able to save some money. I have taken it as high as i can and i have to say my tutors have been very helpful! I don't have a library card as it is all electronic, and i can't access the website to look on my account as they have blocked my access because of this matter! I have had a phone call from them today, saying that after receiving my latest letter the head of the library has decided to remove the charges from my account and allow me to enrol at university, they're still not admitting they were wrong, (the only real mistake i made was to not keep a receipt for 9 months- which i don't think is unreasonable!!) but the main thing is that i can carry on at uni and don't have to pay out money that i can't afford for something that i haven't done!! thanks for the response! xxx

I have had a similar situation arise with my public library, although in your case it is a lot more serious since classes, degrees and careers are on th eline. It seems that the librarians alwys assume that they are infallable and that it must obviously be you that is lying or forgetting. There seems to be no recourse either. Unlike the laws of society, where you are assumed innocent until proven guilty, you are called guilty and that is it with such cases. I suppose you could hire a lawyer and fight something like this, but it would probably cost you more than the fines, and the librarians know it. But I can't wait for someone to bring such a case to court, because it may then set a precedent. If so, it may mean that the libraries can only set rules that comply to such a court ruling.

I completely agree, they seem to think they are a law unto themselves and that they are incapable of making a mistake. I have had a phone call from them today and surprisingly they have agreed to drop the charges and allow me to enrol back at the university, they just said that they had reviewed the case and taken into account my latests letter! to be honest i have to wonder if they have found the books but don't want to admit to it, to be honest i'm not overly bothered now, i do feel as though they owe me an apology but the main thing is that i can now get on with the rest of my degree and don't have to pay out a huge sum of money for something that i haven't done!! I usually just answer through my email so I cannot see what everyone else has put, but this time I came through the other way and so read the first page of responses and I see that you have already solved this! It is really good that they have dropped the charges, more likely they had a good look for the books and found them somewhere else, this happened to my son once with the library. We returned his books and they swore black was white that they had not had them back and they wanted us to pay a fine. I refused and a few weeks later it was all dropped and they were nicey nicey, they said that as my son was a minor they would let it go this time, but I know they found the books but just did not want to admit it and look daft and have to apologise.

its really a problem if somebody or people who think your not trustworthy if that spread and all are agreed with one person about what youve done or not really youve done all will be scared and stay away from you. it is not to good that other accuse you of such thing that you really didnt do... your not the only one whos been accuse...

OOHhh you do one thing ......ask them to show the records they maintain where they mark book is returned or not .... If those records say it is not returned.........accompany your only one friend and go to the priciple/head/director of the college and explain him everything ..... In my college such issues are often dismissed by director/head/principle in favour of students ....hope that will help ..... Hope your problem is sorted out soon .... Take Care Ganesh

Yes it is unfair and I think you should be wise in dealing with this. Know your options and choose wisely. I mean this will have an impact in your immediate future, I think if you can pay then pay, just come to think of it as a charity. It's not worth the fight, for one thing you can't enroll and worst you might loose in the end and end up paying anyways on top addtion the aggravation and delay in your enrollment. If you can't pay then ypu have no choice but to fight to the bitter end, why not ask help from ypur council? or from legal advisers. Good luck i hope you can sort it out and fair.

I have managed to persuade them to take the charges off the account now which is excellent!! I wouldn't have paid them because i knew i had done nothing wrong, the only way i would have given them any money is if they agreed to reimburse me once the books were found, as i know they must be in that library somewherre!! But fortunately it's all sorted now, thanks for the response! xxx

Do you have the evidence that you already return it back to them before the times out?? If you have one, you can protest this problem to dean, can you? if i were you, i cannot accept what people mistakes and then blame it all to me, it's untolerated It seems that what they really want is your money, well i'm not sure for this, but i think they try to fool you

Thats alot of money. I would go nuts. I probably wouldnt pay at all and call them back and say it was your responsibility and your fault that my books have been misplaced so that is too bad for you now.

That's exactly what i have been doing but up until now they haven't been listening! I wrote a really good letter telling them exactly what i thought of the situation and making it very clear that i had returned the books and therefore i was not at fault! After that they have agreed to remove the charges from my account and let me enrol again, which is a huge relief!! thanks for the response! xxx

Sad to hear this.. but dint you sign on note while returning back the books. Usually in our school we were suppose to sign while returning the book so that the school has some proof of it. In a university there are soo many students, there must be record for all this. I think you need to check this out.

It is all computerised and i had a receipt but because i returned the books in december of last year i didn't keep it all this time!! Fortunately though they have now agreed to take the charges off my account and let me enroll! i'm so relieved! thanks for the response! xxx

Munchkin This is a tough situation for you. And if you end up paying that would obviously prove that you were wrong! This is quite strange also. I mean, you must have presented the receipts or things like that! How can they not register your returns! I would want you to go by the counters proofs if you have anything like that with you. Aw thanks mimpi! I don't have any receipts as although they do give them out when you return books and i did get one, because this was last december i haven't kept it! I should have done but it's not the sort of thing you expect to have a problem with - if they had contacted me sooner than july i might have been able to find it! Anyway that's by the by now, i have shouted and screamed (not quite literally!) so long and so loud that they have agreed to cancel the fines and let me back on the course!! I am so happy, if it came to it i would have had to pay them in order to stay in uni but to me that would have been an admission of guilt like you say, so i keep my place and uni, my principles and my money!! thanks for your concern and support! xxx

I would keep fighting for my rights. Can you take your case to a students union who will voice your protest at the top hierarchy to re examine your case? I would not pay for others mistakes. I will try to voice my case until it heard, writing in local newspapers, calling the concerned persons to review my case.

I've had good news in the last hour! my last letter was taken to the head of the library who has decided to waive all of the charges on my account and reinstate me at the university!! i'm so happy!!! xxx

Hey munch, That is really ridiculous! Why isn't there a way for them to find out that you returned the books. Didn't you get some kind of receipt or have to punch some kind of card when you returned them? Don't you get some kind of proof when you return the books? There has to be someone who you can speak with explaining this problem that will listen to you and believe you! There has to be someone in the Administration that will understand your situation and know that you are telling the truth. You have to make someone believe you! Don't you dare give up Munch! Your future depends on you staying there and fighting no matter what! You know that you returned those books and you need to fight to prove it! Go to the head of the school or whomever you need to go to so you can straighten this out. Don't be afraid to speak up and speak loudly!

Hey Opal! I have been stamping my little feet so loudly for quite a long time now, i don't think there's a senior member of staff at that university that isn't aware of the problem!! lol anyway, i have good news, i sent a letter in and after receiving it the head of the library has agreed to back down, cancel the charges and let me back on my course! I can't tell you how relieved i am! To be honest i still think the owe me an apology as they haven't actually admitted it was their fault, but i think that is probably asking a bit much, the main thing is that i can carry on with my training and didn't have to pay them and back down on my priciples!! woohoo!!! xxx

I had a receipt but because it was last december when i returned the books i don't have it anymore!! but they have now decided to waive the charges and reinstat eme at the university, so im really relieved! thanks for the response! xxx

This is quite tricky. If not paying for it will affect your future drastically, i suggest you pay the charges. Think of it as another example of life is not fair. If these will affect you and successfully bring you down then it is time to pull the brakes on your principle first.

If it really comes to it and they won't back down i suppose i will have to pay it, i'm not going to throw my career away for the sake of £265, but i will fight it right to the end, it's a large amount of money and i am being accused of stealing, that's not something i can take lightly! xxx
