ok well here i go....about 4yrs ago i was in a bad spot so i went to court n signed residence over to my ex....well the thing is he had nothing to do with her cuz 2 weeks after that i got her back...now he has this gf and he took her back and is usin the court papers and when we went to court mediation and he lied(hes italian) so hes bull headed and he wants the whole world to bow to him so now im waitin on a court date to go in front of a judge....he has her in a md school and he lives in delaware which i dont know what to do adn she tell me that he smacks her in the face all the time...i called child protective they done nothin and when she not at school shes at his work place all the time and i have her every wed and every other weekend...he makes her sleep on a freezer in the kitchen of the pizza shop he owns....he doesnt even make her wear seatbelt or seat in a carseat.....he cant read or write english so he has this girl that works with him to help her with her homework....the court doesnt seem to be in any hurry to set a date....how do i get her back into a safe environment sooner?

What a sweet little girl she looks like. That is a shame that she has to go through all of that. How old is she? I would keep calling child protective services anyways. Can your daughter speak to you privately on the phone or he he around her most of the time? Maybe if you can try to record her telling you what she does daily and they will see proof of his abuse. Can this be done legall? I don't know. but I would call a lawyer and ask.

he doesnt allow her to call me...shes is 5 and i need to get a tape recorder for when she is visiting me thanks for ur comments

WOW that certainly is a tough one, unfornately there isnt much you can do if you signed her over to him then they will be in no hurry to return her to you, and well ringing child protection agencies they will just look at you as if you are making up lies and stories to make him look bad so then you can get her back!
When you got her back the first time you should of went back to court to get her signed back over to you!
I am really sorry it is sad but there isnt much you can do!

i have tryed and he would tell me things to make me back down but not this time cuz she failing school and he dont even want nothing to do with her cuz i have her xmas and her whole vacation

I am reading between the lines here - he has your daughter because he knows it hurts you, not because he wants her? It certainly comes across like that. He sounds mean and selfish and he shouldn't have custody of your precious girl. You really need a good lawyer, but unfortunately that will cost a lot of money. I hope you can resolve this for your sake and that of your daughter.

yes i know and for some reason i have trouble with her having yeast infections every time i get her and im tryin to get insurance so i can make sure he his not makin out with her and it hurts me so bad....and u hit the nail right on the head..thanks for ur comment

It's a sad situation but unfortunately the courts are on his side since you signed the papers. The only thing you can do is continue to try to seek someone to help, document everything, taking pictures if she shows up on your visitations with bruises and pray the court date gets here soon. It's sad. But, the courts are very slow. Call a social worker or an attorny for legal advise about it. Good luck.
