Which side is right?

I've heard this news from the radio, but I obviously can't recall the exact quotes. I'll sum it up.
In Manitoba, Canada, a man went to his girlfriend's place, and evidently, he fell asleep. When he woke up, he discovered the his girlfriend was making love to him - she was on top, and his pants probably weren't on. He told her to stop, so she did, but she ended up pregnant. The man is suing her for damages like mental distress, anxiety, and because he has to legally pay child support.
I know there's two ways to judge which side is right - legally, and pure-personally.
To me, the man should win the case. It's not like he asked for it. It just happened to him.
Even if he does legally have to pay for child support, it seems a bit like what feminism is trying to get rid of - the man is the man, the one with the job who comes home and supports his family.
