Good samaritan gets sued...huh?

December 20, 2008 3:30pm CST
I just finished looking at a video clip on Yahoo where a co-worker helped another co-worker after an accident that happen and now the co-worker want to sued the good samaritan (other co-worker) because she ended up paralyze. The only reason the co-worker saved her was because the car was going to catch on fire with her in there. She said she rather had waited until trained help arrived knowing the chances that the car would catch fire. What do you think about the situation even though she ended up paralyze? I will not sue the person because they saved my life from something that could of ended my life.

I fully agree with you here. Humans are going to do what they feel is right when it comes to saving someone's life. I know that I would try to save someone. It kind of would come naturally.

I didnt see this article however americans are sue happy and sadly many dont have insurance on their cars im sure this is probably the case. I can in a way I understand why she would sue the coworker when you are hurt this badly you want to blame some one and usually its not the person who hurt you but rather saved you. And unfortunatly because the coworker was not trained they will be sued and the paralized person will win even though it dosent make it right

Well, I am an American and I can not see myself suing someone for saving my life.

I've heard about this news and I find it really ridiculous. The girl just wanted to help her co-worker and she didn't mean any harm. The reason why she dragged her co-worker is because she panicked and she just not want to stand there doing nothing. They should be thankful to her despite the result.

That is the sad thing about it she is not thankful because if she was then the law suit will not be going on. If it was me I will be thanking my friend every day for saving my life.

Way to repay someone who saved her life. She can´t really sue her unless she had proven that her paralization was the result of the process of getting her out of the car; that it was really the co-worker´s fault that made her paralized. Lest she proves it, the co-worker would go off. Anyway, I believe there are certain criteria that are considered in being a good samaritan. You know, like not getting money or anything as such and being with the victim until she´s conscious, and a lot of other things. Oh, and another thing about helping people. Some people get sued because they helped and later have compromised the victim, like being paralized. So people should think before helping, you know, you can get into trouble for that. People should consider things like if she´s actually capable of helping or if she is skilled enough to help. Honestly, this got me thinking, too. If I help people in an accident for example and something bad come out of helping them like losing a body part or brain damage and they came out alive, then they could and would sue me for the result of helping them, right? There´s a thoughtful dilemma. ¨What would Jesus do?¨

Jesus would have us save the people in distress. The ones that sue are the ones that are not thinking right. Their lives have been saved and someone was brave enough and caring enough to want to help. There goes.

Ive also seen that video. That woman is so ungrateful. She should be thankful to her co-worker for saving her no matter she ended up being paralyzed. What does she wants? To end up in the cemetery?

I would thank my co-worker every chance I got because she risk her life to save me. Some people are just ungrateful like you said and not considering the fact they are safe even if it mean they got hurt.

I have heard of this earlier this morning when my husband told the story to me. I would be happy if someone saved my life even if it rendered me paralyzed. Better then meeting with a terrible demise such as a car catching fire and blowing up with it! I tell you. It never ceases to amaze me some of the things that I hear all in the name of litigation and money. So it seems to me that this woman would rather have taken a chance and went up in flames along with the vehicle then for someone to save her life. My hat is off to the person that saved her life. What an act of bravery!

That is what i think she would of rather stayed in the car until help came knowing how long it takes some of them to come. I think she needs to be thankful for her friend.

wow some people don't have the slightest manner to thank others for saving their sorry lives - yikes! the good samaritan would win and she should make this person pay for both lawyers because she wouldn't have to get a lawyer if she wasn't sued in the beginning I can't believe people can be so ridiculous

I think that good Samitans should not be sued for trying to save the lives of other people. I cannot understand why this woman would still want to sue her friend when she knows that her friend risked her own life and limb to save her. Yes she was paralyzed but how could her friend know that such thing would happen in the first place? Her friend cared enough to help her, is that such a crime?

It is not a crime, the lady was trying to help and now look what a good deed got her into it is just sad.

I don't know where this happened. Didn't see the story. But I think this is what the Good Samaritan Law is all about. If that law is not a law where this happened, then I don't know. I am not even sure who all is covered by the law. But the purpose of the law is so that someone doing something like this will not get sued if other damage is caused by the life saving actions. The law was put into place to free doctors and nurses and other medical personnel to be able to help without being charged with malpractice and being sued. I think it covers anyone who is trying to help.

I guess they just looked over this law. They lady this happen to should be thankful for her co-worker saving her life cause she would not be here today.

Ok... so let me get this: she'd rather DIE than being paralyzed... yes, that makes perfect sense to me. If she had waited for "trained help" to arrive, it wouldnt be anything left to save. She should be grateful that she's still alive and instead of suedding (bs?) she should PAY the guy... just my oppinion though! Happy MyLotting and have a nice day! Xp

I do not know what her problem was but I will be so grateful for my co-worker being there because it could of been worser.

I watched this video too and I was upset because how was the good samaritan supposed to know the woman would end up paralyzed? She was just doing her job as a good samaritan and what her instincts told her to do. Now what if the person in the vehicle got burned but survived? She would probably sue the other person for not saving her from the burning vehicle. It is a lose lose situation and makes us more un-inclined to not help others, which is sad.

The person was just concern about her safety and like you said they did not know it was going to paralyze her. It is just so messed up that you can not help a person without knowing you going to be sued.

Yes, it is. I guess the lady would of rather waited for the paramedic to come help her which I do not see the difference. The accident it self would of paralyze her even if the paramedics would of help.
