Gossip Girl star to have to fight for custody of her child over B.S?

I just say that Kelly Rutherford is going to have a custody battle for her child becuase the dad thinks the child should not be with her while she is working. There are certain times when kids would be better with a regular schedule etc. but his reasoning is that she gets phone calls from the set and gets stressed and that makes the baby stressed? The thing is any parent has some stress when taking calls at home from work and she is working a job that may not be 9-5, he seemed fine with this while she was working or is he trying to pull a K-fed and get some child support. Some of these reasons are the craziest I have heard yet, I feel he is just trying to be a jerk thoughts?

I don't know anything about either of the people involved, outside she is an actress. I think a custody battle is legitimate though, especially if he is not working or works a more normal schedule. It's only fair to the kid that s/he have some kind of normalcy, and not spend too much time with nannies. If they both work crazy schedules, or have stressful jobs, then the battle will determine who will act in the best interest of the child. Either way, it's necessary.
