In June of 2008 I hurt my back, went to physical therapy for 20 sessions and after almost 5 months workers comp finally okayed the Mri my doc requested the first day I seen her. Mri showed a moderate sized paracentral extruded disc with mass effect on my thecal sac. I then went for an injection. On November 13th I received a call I missed the IME appointment on Nov. 12th. I told her this was impossible I never received an appointment for that date or any date. Then on Nov 19th I receive from UPS a letter scheduling an appointment for Nov 26th which was requested by the insurance company on the 14th. then on the 20th I receive notice that my benefits where terminated as of the Nov 20th for a no show. The termination notice was dated for Nov 13th. But yet she called to make an appointment for me on November 14th after she terminated me lol.
Oh did I mention the letter sent UPS was sent to the wrong address and it took an additional 4 days to get to me. So on the 12th she said I missed and appointment on the 13th she signed a paper that my benefits where terminated as of Nov. 20th and on November 14th she requested for me to have an appointment with their doc. Does this make any sense. On december 9th I had a nerve block done and a week later I was getting pins and needles from halfway down my back to my toes. It scared me.
On December 11th I received a letter from my employer saying they were glad that I was able to come back HUH. Evidently their doc said I could return light duty for 40 hours a week light duty. Wow he figured this out in the 15 minutes that I spent with him contradicting himself throughout the whole report lol. Mind you I work with mentally challenged individuals No such thing as light duty. My doc said I could not return until my back situation is resolved. Mind you I can not sit for more than 15 minutes at a time and standing isn't in my life I need to lay down to relieve the pain. They offered me 20 hours of office work and 20 hours of asleep overnights with individuals and had to have the answer by the 15th if I accepted or not. My attorney responded and asked for them to be specific. Mind you I am on pain pills and muscle relaxants at night to help me sleep. I did the responsible thing not only for myself but for the individuals that I work with. Well work terminated me on the 17th of Nov saying I never showed, well hello my attorney sent you a damn letter for them to be more specific and they never responded. Reason for termination is that I refused to return to work after a workers comp injury, lawyer asked how stupid are these people lol.
After talking to my reg doc we had decided to go to another rehab that was closer to home since the hour ride there and back was a burden, I could not drive myself therefore I have to have someone take me. Well I went today and after an hour with this doc she is suggesting that I see a neurosurgeon because I have significant weekness in my left side. The appointment isn't until march 17th like the past 8 months haven't been enough pain.
I believe that the adjuster at the workers comp is making things up. My attorney is going to call the doctors office to see what dates I had appointments it just did not make sense to me at all... the 12th I missed the appointment on the 13th she terminated me as of the 20th and on the 14th she requested an appointment.
Oh and I forgot to tell you on Dec 15th we went to a pretrial for workers comp and they said I never went to the IME appointment, ahhh my attorney jumped on that one and was like what are you talking about she has a letter right here from your doc that says she can return to work for 40 hours light duty which was dated on December 3rd.
So my friends would you say they are covering up their mistakes and terminated me because I was entering my 6th month of nonprejudice period? After 6 months of time they are bound to pay me for the duration.
