I went to my hearing for Workers Comp !!!!

On February 25 2009 I went to a hearing to get my workers comp benefits back. My lawyers office messed up and told me to be there at 9am, mind you it is an hour away. After being there for a half an hour I called and the secretary told me she messed up the time it wasn't until 1pm. We decided to go out for breakfast and drive around for a bit. Finally 1pm came.
There I was sitting in front of the judge with my lawyer and their lawyer, I was told that the judge would not even speak to me boy where they wrong lol. He had many questions and I guess it was from the faces that I made over and over again because of the lies that where being told.
I had slipped and fallen on the date of my injury and then went home relaxed for a few minutes when I stood up from the chair I felt pain across my back. Their lawyer told the judge that the injury happened when I stood up from the chair. The judge just looked at him and said counsel please tell me that you are not trying to say that she extruded a disc from standing up. ( he actually held in the laugh ) The judge could not believe that they cut off my benefits before I had even seen a neurosurgeon, he stated that this was a complicated case and he would need to review all the medicals. Mind you I can not move my four toes on my left foot and I have much muscle weakness along with the muscles shrinking in the same leg. I can not stand on my left foot without falling so most of the weight is put on my right side changing my position when I walk.
Yesterday I received his decision in the mail and let me tell you I am happy to report that he has given me all my benefits back and they were ordered to give me the 3 months of backpay as well. I am so happy that this system worked for me, I had heard so many different horror stories I was actually scared to go. Kudos for this judge he actually took the time to find out what the real truth was and cared about the person sitting before him and not the big insurance company.

yeah you are lucky, workman comp didn't give me nothing at all. i felled out of my truck and smach my back on the feul tank and mess up T11-T12, and due the truma of my back it pretty much mess up my whole back. so they settle with a big amount.
told me i can go back to work and all. they claim this and that
my one lawyer i had settle for like $10,000 i was so mad at him. told him we didn't want to settle i wanted permit disable. well that never happen. but i did finally gotten my socail securty

Thanks for your advice but the fact is that I can not do much of anything most days are spent at home with me being in pain, I usually only go out for my doctor appointments. I am sorry your lawyer did wrong by you. It could only be settled if you agreed to it. You have had to accepted the settlement. It is just ashame you should have gotten so much more. The thorac part of the spine is not as common to get hurt as the lumbar and cervical part. Getting social security just shows the extent of your injuries and how disabling they where. Can you bring it up again have you spoken to another lawyer and perhaps he can tell you if it was legal malpractice?

Good for you grammasnook!! That is remarkable!! Awesome!! Your case was ligitiment and the judge saw that and made the insurance company pay up as they should've been all along and now you're getting it all back and back pay as well which is awesome!! See, it takes a strong and truthful person to make it through and you're just that!! Good for you!!
