Should this Halt the prosecution?

Today in news I have read that the lawyer who was appointed to defend Kasab, The lone captured Terrorist in 26/11 attack, has decided to not fight case as the Shiv Sena people attacked her house yesterday. I am not supporting what they are doing, but I must say I do not know what type of Law is that where the open criminal, who has killed so many people and also from foreign country needs to be defended by our lawyer. Many have written comments that it will only delay prosecution. I do not know whether it is justified to be delayed in this water tight case until and unless such a criminal is "Defended".

Hello subha12 I fully agree with you. The person who has killed lots of innocent people by inhuman way our government is providing lawyear. It it nothing but to delay the judicial procedure. We do not understand what is our country's law.

There is no problem with our country law. It is perfect and working as expected. In a country of this size with only 31 Supreme Court Judges, delay is sure to happen, but we have adopted the judicial system of the USA and it is the best suited for a quasi federal like ours...
What do you want to say..should he be hanged immediately. Our image in the world will be degraded if we do this. and then, the proceedings in a court brings out the best information from a culprit than the police records which may be fabricated. There is now even an iota of doubt that he will be hanged but let us get as much as information from him...and with this show the world how mature we are.
The attack on the lawyer is unfortunate...even if she withdraws, the government of India will have to arrange a lawyer for Kasab...

Hello subha12 your contention is no doubt true. We are living in a democratic country even though he is hard core criminal and terrorist and his crime should not be pardoned but still he is human being and as per version of law every one has right to defend himself. Though I am supporting the activities which they have done but law of our country is peculiar. Our is the only country where the interpretation of law is fully defined and implemented for that reason we are providing lawyear to a terrorist to defend himself.

I think as per the constitution it is necessaty to represent a lawyer otherwise some day it will be said that the judgement was partial...but i am totally against the activities of these people..

In this case, I think he must defend himself.
but if the law says that every one should have a lawyer, there is no wrong in defending him, because the lawyer will loose, the truth only will win.
the shivsena is taking millage that's all.

i was unaware of this and find this discussion of great interest on many levels.
1...of course the defendant needs to have a equal defence lke the person accused of theft.
2...we know he is guilty...let justice take it's course. if by some profound miscarriage of justice he was found innocent...then let the mob prevail.
3...how few responses to a great mylotter..let mylot be above the fear of stating a right to freedom.

Its always been the policy of Shiv Sena of making issues out of non-issues, to keep there votes intact. The law can't be changed for a single person and it will take its course, its in our law that a person has every right defend himself no matter how much bigger crime he has committed. The layer should be provided with appropriate security, as she's still interested in fighting the case, no one in this country should think himself above law may it Shiv Sena or whatever.

We are a matured democrcacy and the incident like this must be stopped where Shiv Sainiks attacks every now and then to the constitutional values.
As for Kasab, let the judiciary decide what to do with him. Constitutionally we are bound with the theory of natural justice where the golden word is no one will be deemed to be a culprit unless proved. We all know here that Kasab is a culprit and he will certainly be accused for waging a war against India. His judicial punishment is a matter of time. But let not it be proved as a judicial killing. He must be provided a lawyer and in any way government of India will have to arrange a lawyer for him.
As for time, I think there is no harm in waiting for two years.
Ramjethmalani fought the case of people who killed Indira Gandhi. There are other numerous instances in India. It is also not a national matter now as the whole world will see the fate of this case. Its about India's image. So keep sentiment aside...
