Boss playing internet poker adn calling me at all hours of the night

My boss was complaining all today about how he is soooooooooooo behind on his work and just now, what do I hear coming out of his office. The sounds of him playing internet poker.
He does this all the time and his computer gets virus because of it. Im thinking if you are soooooooooooooo behind on your work how do you have time to play internet poker.
When my boss chooses to do this(play internet poker instead of working) he will start working after I leave at 5 and then call me at home around 7 8 or even 10 and ask me were stuff is and what did I do with this or that or what did the client say about this or that.
I hate it. I work from 8-5 but I fell like Im a doctor on call with how he calls me at home. Most time I dont answer the phone cause I fell like you need to do work when you pay me to be there. Dont expect me to answer the phone when Im off.
Has any one ever had a boss like this!!

I think I would be inclined to have a chat with him about phoning me at home, unless he's going to pay me for being on call. If your job comprises work done in the office, then there should be no need to call you once your day has finished, but instead, he should work with you, and play his poker when you've left the office to go home. That way, everybody would be happy.

I've been at my job for two years now and I dont think he is going to change. I think he is set in his ways. I have asked him not to call after 8:00 but he became mad and said I will call you whenever I need to to get what I need to get done. What makes me the most upset is that when he calls his only asking for things like were is this file or that or what message did someone leave him. If he would just look at the phone messages I leave for him and look in his file cabinet before calling me he could answer these questions himself.

I personally have not had a boss like this, but if I were you(and if you can), I would speak to human resources. He should not be putting off his work during normal working hours and playing internet poker. He can do that at night instead.
There is no reason what so ever that you should be working after your scheduled shift, no matter what, unless you are on call(and getting paid everytime they call you--lol).

I would go to Human resources if I could but I work for a two sole practicing lawyers. They are husband and wife and Im the only employee. I have no where to take my complaints. Thanks for responding.
