They aren't paying me

When I submitted my application for a Residence Card, the Home Office sent me a letter stating that I could already seek employment while they were processing my visa. So I started applying showing the letter. In short I got a job. Two weeks later, they wanted/demanded to see my passport which I didn't have yet. And they asked me to stop working and said that I could get back to work when I get my passport back. Also they wouldn't pay me until then.
Five months later I got my passport and visa but alas they don't have a vacancy anymore. When I asked how I could get my pay the resource person said this: "You have to write a letter to the finance people and see if they will pay you, because really you shouldn't have worked because you didn't give us the right documents".
I didn't like what I heard. They accepted me with the documents I had and now they are accusing me of giving them improper documents.
Right now I don't know what to say in a letter to give them. I am bent out of shape and I don't want to say things that I would regret later. So please allow me to rant here for a minute or until I get my sanity back.

Hi Jemina. If I were you, I'd definitely be angry and devastated. Been told to come back, they should have at least reserved a place for you. Seemingly that you have worked with them before the issue of the passport came right under their noses. This is unfair. Can't you get the Union to look into this matter, or is there an organization body that could help you to look for other job, and at the same time, pressing the company for the period which you have worked. That is their problem entirely since they are the ones that allowed you to work for 2 weeks, even though they then demand your passport and using the excuse that you did not give valid documents.
So during the 2 weeks and the interviewing time, what were the HR people doing? I hate situations like this whereby companies used the energy of employees and due to this and that, do not pay. At least pay for the period that you have worked. The journey to and fro that work place needs money and not free. I don't know how to say about this matter. Writing a letter will only either improve the situation or worst, you will have more ding dongs to come before you even see your 2 weeks wage. Sorry this has to happen to you. I suggest you keep on pressing them for your pay and look for another job.

I'm not sure if I'm entitled to seek assistance from Union because I'm not a member of any. I didn't have a full time and was doing only freelance. Anyway, yea, I already found some jobs and even if they would take me back later on I wouldn't go back with them. I just want to get my 2-week wages. They have to give it to me by hook or by crook.

I would love so much to say "I will never set foot on that ground again" but alas it's a hospital and sometimes I go there for check-up.
Anyway, the hospital was not my direct employer which is a good thing and hopefully we would settle things out as soon as possible.

Hi Jemina!
That is appalling to say the least! They used you Your dosuments were good enough when they needed someone to fill the post and now they are prepared topay you for the work you did! Can the empployment office help you in this? They are completely in the wrong and if you were told that your documents were sufficient to start and were accepted by them in the first place then now thay are not playing fair at all.
I suggest you contact all involved and try and get to the bottom of it because there is no way they can be allowed to get away with it!

Exactly, and it wasn't my fault that my documents were not sufficient enough to start working with them. Another thing they told me was that I had to go back from the beginning which means I had to apply again. But I don't wanna go back and work there again because of what transpired. I got a freelance job for now and I think I'm going to the Citizen's Advice Bureau today for some assistance on making the letter. I'll keep you posted.

That's exactly my point - none of it was YOUR fault and YOU should not be made to pay for any of this. Even now you will have to waste YOUR time following it all upand that is just so not right at all

This is already an 'old' discussion and the last post I see you made was some weeks ago but sounded hopeful. I trust that you did get your money in the end. If you had papers stating that you could work and they employed you on that basis, they have no real cause not to pay you, even if their admin needed more documentation. You have worked and deserve to be paid for that work now that you have all the documentation that is required.
To be honest, it sounds like a small mix-up in their HR department with one person saying one thing and another interpreting the rules more flexibly. Personally, I would not like to be in the business of employing aliens in the UK right now. The Government have recently made new laws which penalise employers heavily if they employ someone illegally and I am sure that has caused much confusion in some HR departments!
If your problem is now sorted out, congratulations! If not, you just need to be firm and assured of your rights to be paid for work you did and, at the same time aware of (and understanding of) their problems. Keep on at them with queries and asking for progress reports and so on. If you are adamant but fair, you can only earn respect, not enemies!

As of the time of writing, I haven't received any. I am completely aware of the employers' liability in employing illegal aliens. But sometimes they take on the wrong people. I really think the HR who accepted me in the job should act on my behalf. To be honest I'm not comfortable chasing them and inquiring about the backpay which was only around £250 anyway. I could give up on it but my husband want things to be straightened. He being a European is not happy at the kind of treatment I got.

Did they let you know in writing that they would accept the documents you had, or verbally? This is really poor treatment by them. I would seek the advice of a solicitor or at the very least, a citizens' advice bureau, to see where you stand on obtaining your money. It can't hurt to make enquiries. If you feel the need, then drop them a line to tell them you're seeking a solicitor's advice. They may pay you on the strength that they don't want to have to pay court fees for losing their case over such a small amount of money. If not... go ahead and seek advice. I think they might suggest a tribunal, and you should get somewhere with them.

The mere fact that they had you sign a contract of employment, is proof enough that they accepted the documents you presented, and I would ask for a letter stating what they did over the phone, that higher management couldn't accept those documents, even after you commenced work on presenting them.
I'm sure the CAB will be of help to you, and will probably tell you the same thing, that you need stuff in writing. Good luck, my friend.

After posting this morning I felt so much better and calmed down and tried to call the HR office. Luckily, it's the other lady. She was so much nicer and told me to take my passport to her and she'll see what she can do. I do hope we'll be able to settle it without me having to resort to consult CAB at least or whatever.

They accepted the documents when I went for the interview and the signing of contract and let me start working. But when the higher personnel checked my papers they realized that they weren't sufficient--at least for their own standard.
Well, I'm going to the CAB today and see what assistance I can get.

That's horrible Jemina. Can't blame you for being upset. who wouldn't be. It doesn't matter whether or not someone accepted the wrong documents. The fact is ....they accepted them. You worked and earned your pay....simple. They should have paid you long before now and you shouldn't have to go to all this hassle just to get what is rightly yours. So I see this was written 4 weeks ago. Do tell us....how did this all work out for you? Have you been paid yet?

Yea, it's been about a month since I started the process of claiming and two weeks ago they told me they were gonna pay me. But they didn't. I don't want to take drastic actions, like consulting Citizen's Advice or any solicitor, you know? I hate making enemies. As much as possible I want it to be settled in a diplomatic way.

I think anywhere there is always some sort of craps one has to go through especially for people like us. It just depresses me that I have to go through all of these--visa, paper works, and stuff. Husband has been very supportive but I need an expert's assistance for this.

Personally, I guess if I were you, your Best defense is to contact the head of that management place and share your thoughts, and see if they can resolve something from there. Personally I think it is against, or hopefully so for all companies and this does not sound like Good Business practices for sure. All I would say is do what you can do, and look for a different type of job, and if they can never come thru let this be a warning they might not be one of the better companies to want to work for as well.

Thank you, Krause. I have got a positive message so far and they told me they will pay me this week. I just hope they will be true to their word. But because of the treatment I got earlier I got disappointed with them and looked for another job. Thankfully, I got one although it's permanent part-time at the moment.

Unfortunately, not yet. Last week I week I went to show them my Residence Documentation stating I am allowed to work. Then they told me to call back this week to find out how it's going. Sad to say, it's already the middle of the week and still no positive sign showing up.

hi jemina,cool down..sometimes its very difficult to deal with people..esp.if we are staying at other countries..2 weeks working is too much for you to do,hoping they have their conscience to pay you..but i if you can find another..dont bother to get it..you will only hurting yourself

Hee hee! (Grins Grins) Thanks Marketing, I am calm now. I was just at the height of my emotion when I posted this and that was why I didn't want to talk to them during that time because could be very blunt and I don't like it.
It was too much and the transportation cost and the time spent by my husband sending and picking me up--they all add up.
