12 yr old boy died in a car accident

My friends little brother died last week, he was only 11. He was riding in the back of a pick up truck, when his grandma made an illegal U-turn and was hit by a flat bed truck, the boy was thrown out of the truck and broke his neck. In my state, you have to be at least 16 to ride in the back of truck unrestrained. His grandma was charged with making the illegal U-turn but not for having him in the back of the truck. There was also another boy in the back of the truck, but I am not known of his age, but I know he was under 16. What do you think? Why wasn't she charged for having him in the back?

Oh my goodness thats awful, I'm sorry to read such terrible news, as for why the authority's didnt charge the person responsible for allowing the child to ride in the back of the truck, I dont know why becuse I'm not sure about the laws where you live, but I can only say that what happened is very unfortunate and sad, and I just hope that future drivers in your state learn a lesson from the tragic event.

In my state they need to be at least 16 to ride in the back of a truck, but I think the law used to be 12, and he was close to turning 12, so I think that might be the leeway in it. Maybe she didnt know the law had changed. I dont know where she was going, but maybe she was just driving to the gas station, and didnt think she would need to put him in the front of the truck.

Is a document with several rules for child restrained in vehicles. In one state I noticed charges will not be made if a vehicle has no restraints for a child and many sites mentioned children being restrained in a rear seat. I think the grandmother innocently let the child sit in the back because the child may have wanted to be seated there. It is unfortunate, that the grandmother got a little careless by making a u-turn and wish her and the family the best.

True, Im sure he wanted to sit there, Im sure it made him feel cool and gave him some pride being a little rebellious. Its unfortunate that this is how it ended.

Had gram mom, been obiding the law this never would have happened. First you never let a child in the back of a truck,second she made a illegal turn. The illegal turn is fine we all have done this ,though not thinking enough of what could happen to her, grandson to let him ride on the back is beyond me. Very sad to hear this ,I am sure that gram is going to be the one that finds it hardest, to live with herself and could be charged ! Considering that she broke the law twice.

I dont know how I could live with myself, knowing that It was my fault that my daughter lost her son. I wont even ride in the back of a truck myself, much less let a child do it. Although I do remember riding in the back when I was little, I dont think the laws were that enforced about it at the time. But I do remember being really scared riding in the back.

That is terrible that the 11 year old boy was killed. The grandmother must be really upset and feel awful about what happened. The boy's parents must regret letting their son ride in the back of the pick up truck. It is strange that the grandmother wasn't charged for letting an under 16 ride in the back of her pick up truck. She made an illegal u turn so that was against traffic law. In my home country there are clear guidelines about children having a baby seat or child seat. Seat belts protect children older than 12 years old. A driver would be charged by the police if he or she let children under 12 years old ride without a proper restraint.

I am not sure why she hasnt been charged. Im sure she feels bad enough about it, knowing that it was her fault that he was killed, but I still think that she needs to be charged for it. We also have strict laws, anyone under 12 is not even allowed to sit in the front seat if at all possible.

I would hope that she will be charged for this in some way soon. The charge for the u-turn is really just a slap on the hand for what her actions caused.

I am not sure why she wasn't charged for having him in the back of the truck. But this sure is one said story to hear. Maybe if she was doing the right thing in the first place and doing what the law says then maybe things would have been different.

I know, I feel that if she had him properly restrained, this wouldnt have happened. There was another boy in the back as well, but he wasnt hurt, I wonder if the boy wasnt sitting in a safe spot on the truck. Maybe he was sitting on the tire, or the edge of the truck.

I am so sorry to hear about the accident. Another one I heard was about a little boy knocked down by a truck when the driver was pulling back, but not seeing the boy just behind. Drivers and riders need be especially careful about kids in and outside the vehicle.

That is a very sad story, but also a crazy law that you can ride in the back after a certain age!!! :-(
Here in Australia it is illegal to be in a moving vehicle without a seat belt in all states! I know of people who have been fined for sitting in their car with the engine running and no seat belt!! Buses are the only exception to this seat belt rule!
I think she should be charged as it will make others think twice about doing something so irresponsible! No doubt she will already be feeling bad enough though! :-(

this is such a tragic loss, the grandmother must be feeling so devestated at the moment, i guess some choices we make in life determine the direction which our life will take. in this instance what a terrible choice with terrible consequences. sorry for the loss x

That is so sad...
It really is so sad that people can be so irresponsible and cause the life of someone else, especially in the sense that the lost life was just a budding, so much potential for that child. so much he can still do and experience in life.
I don't know why she wasn't charged, they may have their own reasons we don't know but no matter, a life is lost and that is really sad.

At his age, he should not ride at the back of any vehicle to avoid accident. The authorities will have to look at some angles of scene before giving a charge.

Maybe you guys live in a rural area? I know that in farming areas, 12 year olds can ride a tractor for helping their family with work on the farm. But in the city, it is obviously illegal for the 12 yo to drive anything but a bycicle.
