My bank scammed me

When I opened my account at B of A they asked to to choose a kind of check book along with my ATM card. They didn't say anything about charging, they just say choose. I thought is was necessary since I needed my ATM card and it came as it set but now 26 dollars is taken out of my account because of some check books I wouldn't even be using. Shouldn't the option of not getting those check books or even the fact that those check books cost money be offered to me?

they havent scammed you though they have mis-sold you the items if you have no need for them,
I assume you read the contract saying that I know I dont if you had one.
Here in uk you would be able to go to the FSA and banking ombudsman and complain about the way the bank sold the items to you.
Not exactly sure what the process is in your country but you will of had to sign I assume for them and it should of been clearly stated on the form you signed.
If you havent signed for them then you havent entered into a new contract and you should complain to the manager and not leave till they have re-funder it as without a signiature you have onlt verbally entered into a change of details.

There was no contract. The person at the bank took care of everything behind his computer. He just showed me the catalog and said choose your atm card and check books. He told me if I wanted a check book case it would cost money but shouldn't he also say the check book themselves cost money?! Ah well, thanks for responding

Hello, sorry to hear that but everytime the bank ask you then you have to ask them back if there any charge. I always do that... this is your new bank account? if so, then you can call customer service and tell them what was going on. sometimes they will offer you free check for the first time customer, but ATM card is free tho.
to be honest, I dont like B of A at all... they are just something else. I have Chase bank and they always help and solve what I need. I love the best is my Union Bank... Nice people and always have money available right the way once I deposit it no matter after time or whatever

Yes, when I looked into banks people have given good reviews for Chase banks, Union banks, and US banks but I need to choose the bank where there is a ATM near me. I didn't want to go back to B of A but I couldn't pay 2.50 to use the ATM every time. Going to talk to the bank on Monday. Hope it works out. Thanks for your response

It really does feel like a scam. Hopefully I could talk to them and get them to refund my money or at least let them know that they should ask whenever fees are involved. Thanks for your response

Your right they should have told you up front what it was going to cost, that was misleading of them. You can try to get your money refunded. it might not do any good. Banks these days are pulling all kinds of crap to make money. They have lost money with the economy too and are trying to recoup some of it back.

B of A is a rip-off bank plain & simple. They are supposed to tell you that you are being charged for the checks. $26 sounds like an awfully high fee. I think you will find out they charge you to use your debit card also. Not a per item charge but a monthly fee. I also think you can print your own checks once you have the bank routing number & your account number so you NEVER have to pay them again.

I had to open at B of A because Citibank isn't one of the banks at my college. I also think it is a rip off but nothing much I can do now. Thank you for responding

I tried calling the costumer service number but couldn't find any real person to talk to me so I'm going to the bank on Monday. I'll stand tall to the manager like you said. Hope it works out

Actually , you were lucky. Citigroup is MUCH worse than BoA!!! Go in & speak with the manager to complain that the fees weren't explained & had they been you would have NEVER taken the checks. She may try & talk you down, just don't give in & keep complaining. During the conversation, ask her for the name of her supervisor. Or just skip over the manager & send an email to BoA Corporate Office complaining that the fees were never discussed with you & you didn't want checks but was told you had to take them. Then you were charged $26 for checks that you didn't want. No matter which route you take, DON'T take no for an answer.

I watched before an episode of Oprah, where Suzie Orman was a guest, she is financial consultant, that we have to be very careful because there are some banks that give hidden charges. They have ways of luring clients to sign an account with them and in the end charge you with rates that were not discussed. They would tell you that you should have read the TOS, which is true. But sometimes, you are immediately asked to sign which is their trick.

I read all the written material that the bank gave me because I had some bad experiences with some heavy charges no one told me about. But still after reading everything, no where does it say they were going to take money out of my account for the checkbooks. They shouldn't assume everyone knew....Thanks for responding

Go to the bank and tell them that when you registered you were not informed that you would be charged. Since you don't need the cheque book would it be possible for them to refund you the $26. I know a lot of banks will be willing to do this if you tell them that you will go to another bank if they do not, based on the fact that if they are charging you for unwanted cheque books then what other charges might they have hidden.

you mean they, not only one person told you to choose that option. anyways, sometimes they assumed that you will be needing one. i don't think for whatever reason they said that, that you can still do about it. haven't they explained to you that the checkbook will cost you some fees. but in a way i think they feel that think you can afford to have one so they don't think that you will mind at all. but sometimes not being offered or emphasizing that it will be costly insults me caused it made me feel that they looked down on my status or ability to afford that checking accout. and there being informed beforehand that it is expensive to have checking account and should not have it can be offending and maybe just maybe that is what the are avoiding to do to yor or avoiding for you to feel that way. so i guess they assumed you know about the fees that you will object if you don't like what they were proposing to you.

Sigh....Is there no trustworthy banks? I've also heard in Hong Kong that the bank people actually scammed these elderly ladies out of their life savings to buy these stocks and lost all their money. Nothing like that has been done to me but I don't really feel my money is safe. Thanks for your response

I guess I'm not particularly sure why you feel like you need to use B of A. It may be one of the only banks on campus, but is there not a town around your school? There must be other banks. I steer clear of B of A, I have only heard bad stories from them and while Wells Fargo is not much better, I hear fewer horror stories about them than B of A.
I use USAA, which is only available to family members of people who have been in the military, if either of your parents (and maybe even one of your grandparents) has participated in the military you can sign up with no problems. USAA is a government run bank, it does not have banks that you can walk into, everything is done on the internet and you can use an ATM from any bank and they will refund up to 10 dollars in ATM fees a month because of that. You can scan your checks to their website or send them in the mail, and I have gotten checks for free or less than $10 since I opened my account 7 years ago. They have credit cards for students that have very low limits, just to learn how to deal with credit and customer service is the best!
If you don't have anyone in your family who's been in the military, I suggest WAMU, I realize that they've changed names or mother companies lately, but before USAA, I had WAMU and they don't charge for anything except overdraft fees. It was a good bank. Don't give in, talk to that bank manager and return your checks, there is no reason, if you haven't opened them that you can't return them.
Keep your eyes open and change banks if they do stuff like this too often. A bad bank can give you bad credit sometimes. Protect yourself. And have a great first year at school!

No one in my family has been in the military but that feels like a great bank. You're lucky you're being taken care of by your bank. Is WaMu the Chase banks now? B of A is on campus so I thought if i use them, taking out money would be easier. Maybe I should also look up banks in the town

The bank's employers was no so good in their works. Of course they should told you they will charge you if you choose the check book. So there is no free services in the bank that we can learn from this thing. Every time they say something let us choose, we must ask them more clearly.

Yes, another user also told me it was a good lesson to learn so I guess I'm glad it's a cheap lesson. I just thought that they would take care of me when I open the account. Ah, thanks for the response

unfortunately you have suffered because because you were not aware of the doctrine of 'Caveat Emptor'. this simply means 'buyers beware'. most salesmen get commission from what they sell in this case opening a bank account. every type of account must have had different commissions so you were given an account that would get the salesman the maximum benefit. next time you remember that the customer is the king, don't act in haste. take all the time you need to reach a decision. ask as many questions you can to clear any confusion. and it is not necessary to buy or open account on your first visit only. evaluate all options available and then only decide. that's Caveat Emptor - buyers beware.

Even though people did not give good reviews for Citibank either but when I opened my student account there under my mother, they took great care of me. I guess I can't assume that sales reps would act reasonably. I'll have to be more careful. Thanks for your response

If I were in your position, I'd go and find some time to compose a horrid letter for fun and then shredding it and calling up their manager for a chat and hope to reap benefits other than a full refund. :3

Ah, a horrid letter just for fun. Harmless if I shred it but disastrous if I'm still mad afterward and decides to send it in. A lot of people are telling me that check books have always cost money so the bank just assumed (they shouldn't have but I also should have asked) that I knew. Still a little upset and feeling cheated though. Tomorrow I'll go to the bank and see what happens. Thanks for your response

If you were choosing from custom checks (pics of kitty's or stuff like that) then YES you will always be charged. thats pretty much a given, and most ppl know it already, however just having looked at your profile and it says you're 17 and this is probably your first checking account they SHOULD have informed of what every step was.
you should complain, if for no other reason than the manager knows that this one person isnt doing his job properly, whether you will get a refund is very doubtful since they check have already been printed with your info.
get into the habit of asking "How much extra is this going to cost?" for just about everything in life lol!
also be aware that very often unless you have your payroll check setup to Direct Deposit into your checking account, you will be paying a monthly fee just for having the account.
and many times there will be an additional transaction fee if you use your B of A ATM card at another banks machine..you actually might get double charged, one from BofA and one from the bank who owns the machine for not using THEIR card.
you'll find that companies are "stickin it to ya" all over the place!

You weren't scammed. If you're an adult, the person you were dealing with would assume you know how banks work. It's normal procedure to select the kind of checks you want. And I doubt that they'll give you your money back because the checks come from an independent company. Every bank I've ever had an account with uses the same check printing company, and it's the company that charges your account, not the bank. Instead of assuming that you had to make a choice, you could have told them that you wouldn't be using checks. Consider it a lesson in growing up and dealing with the real world.

I still think they should have told me it costs money. It didn't cost my mother any money when she got checks from the bank she uses. Uh....I guess it wasn't that expensive for a lesson (don't trust banks!). Thanks for responding

When I opened my account at a different bank the man told me to order checks from one of those places that are cheaper than banks. He was really cool and said I didn't need to have a bank copy to get the checks I could just go online. I really didn't want checks since I never really write them.

Hey anime! As far as I know all banks make you pay for checkbooks!
I know my bank does! And it is only for the plain ugly ones! I
think it is automatic that they make you have checkbooks if you
want to have a checking account and atm card! Even it you aren't
planning to use the checks you need to have them just in case!
I don't use checks too often but I do use them! I pay my landlord
by check and my utility bill by check! The rest of my bills get
paid by phone or online! I think it is just a formlity and it
is something that you must have to have the account. You should
check with the bank, but I am pretty sure it is something that
is non-negotiable! And you just might have to write a check sometime
so they are good to have!

I guess I'm particularly mad because I used to have a Bank of America account and they charged me over 50 dollars in fees. I need to use B of A again for college but I was a little worried before the fee that my money might not be 100 percent safe. Ugh, I don't know. I still want to talk to the bank. Even if I might not get my money back, I need to regain some confidence in the bank. Thanks for your response

I am not sure how the banks are in the USA, but here in Canada every bank unless you are a senior charges for checks. They also charge service charges for practically everything you do now. You certainly should have checked out what is freeand what will be charged for when you opened the account.
I see you are quite young according to your profile, do they not have any student type accounts where you get free checking or other free charges. I would certainly be asking more questions.
good luck on sorting this out but I think you are stuck with the charges for the checks.

It is a student account and they said no charges for using the checking account and the representative didn't explain that the check costs money. I'll just go and see if I can straighten it out on Monday. Thanks for your thoughts

If you really do not need it, you have an option and the right to ask the bank to close your check book...If you are really sure that there is no proper communication about the terms, conditions and cost of opening a checkbook with that bank, you can even ask them to reimburse the amount that you have paid...You are a customer, remember "customer is always right".
