Is it a stealing from bank?

There have been many news reports on people getting more free money from bank just because of the ATM problem. This also has been a hot issue in CHina, for a college student was charged for getting money in this way, and he was sentenced to be in prision for several years for the illegal money even though he already returned extra money to the bank. How should we judge, could we regard this kind of action as a crime? From one side, it's just the bank 's ignorance lead to their own losses, the boy had no intention of getting more free money from bank.While the boy was wrong for can not resist the temptation of monwy, and get it illegally. I think we should judge it from a moral side rather than a criminal responsibility.What's your opinion?

the additional money resulting from a malfunctioning ATM is not yours in any way and has to be returned. help justice flow throughout the world by being just.

I think so, too. Any undue payment made to you should be returned. This is not intended for you and should not be considered to be your own. Conscience and moral values should dictate one to be honest all the time. One does not have the right to unduly enrich himself with the honest mistake of somebody. God is watching!

If the ATM machine gave him more money than it should have and he returned the extra money to the bank I would not think that is stealing. It was not his fault the ATM machine was not working properly. If he kept some of the money than that would be stealing.

I think there can be a difference between stealing and being dishonest. If the mistake was made by the bank, or the bank machine failed, then no, it isn't stealing.

Stealing is stealing is stealing. It doesn't matter from where we steal, it's still stealing.

I think the bank should take responsibility, as it's their own fault, but the boy should have resisted to temptation too. Receiving money that doesn't correspond you doesn't mean you should take it.

It's human beings' weakness towards money.I don't think he should be charged as a theif and sentenced to prison. Instead i think he was also a victim caused by the machine and behind the machine are people of the bank. Though he also had the major responsibility for the whole affair but shouldn't have taken so serious a consequence.

How did the boy able to get hold of the money? I presume it is a case of overpayment from an ATM machine? Whatever way it is, that money was not his. Moral instinct would dictate us to return the money to its righteous owner or to the bank, for that matter. I hope I remember it right, but there was one celebrated case of a bank error where a person's account (let us name him "A") was credited with a huge amount intended for another party, "B"). "A" kept the money to himself and started using the amount. There is always a way for the bank to find this out and it surely was an undue payment to "A". "A" was found guilty (I don't remember what crime was cited) and he was imprisoned and made to pay for the amount.
Dishonesty is a costly thing. We better avoid it and stay honest all the time.

Each country and each city have their own laws regarding this issue. Here I know that that's one topic with a lot of gray areas. While some inssist that money lying around is considered "public" properity," at the same regard they consider it stealing if you just happen to "find" it. However when this issue had been braught up an arrmored car carrying new money crashed causing a huge spill out on the highway. Police had to block off the area until crews cleaned up the mess.
However, with wind and what not it is possible that not all the money was recovered or taken even if the news made it look like it had been and none was missing.
Its... one of those... if your caught it can be considered such" deals. and ATm's here are equipt with cameras to prevent problems like that. Well they hope anyway.
