My dogs are getting me in big trouble!

I am the proud owner of 7. I have 2 dobermans, Austin & Buck, 2 pit bulls, Cowboy & Shooter, 2 yorkies, Tiger and Lilly, and a persian cat named Jasmine. I keep my 4 big dogs outside, i am a paranoid person, and I feel much safer knowing that my dogs are outside guarding the house. The neighbors, however, are not so fond of them. I live by myself in a house, and a couple of years ago i had a pool built on my backyard. There are a lot of kids in the neighborhood i live. One saturday night, when i was asleep, a few high school kids decided that they wanted to go for a swim in my pool. I have a fenced in backyard, so they pretty much trespassed on my property. I also have big signs that say BEWARE OF DOGS. The kids were attacked by my dogs. All 3 kids had to get stitches. I received a letter from the kids parents, and other neighbors, that if i do not get rid of my dogs within a week they will file a lawsuit against me. I don't know much about legal stuff, but these kids were on my property, they jumped a fence. So of course i didn't get rid of my dogs. 2 weeks later, i receive a letter from a lawyer saying that there is penal lawsuit against me! and i could receive fines of up to 500 grand!!! Can anybody give me some advice??!! i am freaking out, i refuse to get rid of my dogs, and i don't know if i should et a lawyer, i really don't wanna pay someone. Any advice??

Tell the parent's they either drop those charges or their kids get charged with trespassing. In order to sue you they have to admit to that. Perhaps they'd rethink their actions then.

I completely agree. The kids would not have gotten hurt if it hadn't been for trespassing on your property to use your pool when they have no right to. I would be ready to go to court if need be...maybe take pictures of the signs you have up that say you have dogs...and add that this happened without your consent. People can be ridiculous. Why can't people admit nowadays that their kids aren't perfect angels? The kids did something stupid. They were hurt. Maybe they should focus on learning from it rather than looking for someone else to blame.

i don't blame your dogs they were protecting their home, that's part of why you have them. are the kids getting in trouble for what they did, to cause all this. or are they only seeing it as dogs bite kids, and their big nasty dogs. do u take them out walking in public? i was told by a friend, they live in a not so good neighour hood. if they don't have a protective dog for their place it will get broken in to, same with the people around them. i'd say just bite the bullet and go to someone about it, cause it's not fair to put the dogs down just cause teenagers did something they shouldn't.

Get a lawyer! You have signs posted, those kids trespassed. Unfortunately you may have to give up some dogs, most cities have ordinances allowing a limited number of dogs per household. Your pit bulls, in some areas are considered dangerous animals, check with your lawyer on that. As far as the lawsuit, I don't think the parents have much of a leg to stand on, you have the Beware signs posted, the kids were aware that you have large dogs outside your home, the kids were wrong but today parents don't believe their little darlings can do anything wrong.

Oh, I forgot to mention. The lawsuit is against you so you may be entitled to Legal Aid - free legal help.

hi baluyadav, were you thinking of another response when you wrote this? don't panic my work mate made a real big stuff up this week, by leaving a gate open and 20/30 cows walked out the yard. you have to see the funny side of it. these things happen

I think I would hire the lawyer. The kids were in the wrong. Were the police called the night of the incident? In my state hospitals are required to report dog bites and the animal control usually comes out and quarantines the animal for a perod of time. If none of this happened it can only serve to make your case stronger I would think. There are times the smart thing to do is pay for advice..this is one of those times.

Even if every fact would make me think there is nothing wrong in what you said, it's important to ask for advice to a professional in legal matters that can help you deal with this situation. It's sometimes sad to see the attitude that some people takes in these situations. wow you have lots of pets. i only have two cats at the moment. they are my everything and light of my life. i could take one kitty but that's tops of animals I can take care of.

hi rachael! check your local, federal, and state laws. i think you have a chance at winning this lawsuit but i'm no lawyer myself. i'm sure there are lawyers who would offer their services for free. hope this helps and do keep us updated. cheers!!!

I think you may need to get a lawyer. but I think like you do those kids were trespassing so how is it your fault? -there are warning signs posted. can you help it if the kids are idiots? I have four dogs however I keep mine IN the house.. I feel safer if the dogs are NEAR me- the dogs can't protect me much if they are locked outside. They PROTECT MY HOUSE-- no one comes IN! all my neighbors know I have dogs. you can hear them bark.. someone would have to be an idiot to come IN my house, when I am there OR when I am away.. I don't leave them in the yard because the yard can't be stolen! And people can still break in through the front of the house and what good would it do to have the dogs all locked out in the back yard.. I have had my neighbors kids hop my fence too- to come looking for a ball. As my dogs were barking at the window like crazy- I knew there was somebody tresspassing so I went out there to confront them.. However the dogs did push there way past me when I went out and my 2 girls chased those kids right back over the fence.. tried to grab a shoe.. but kid made it over.. I just find it safer this way. No accidents happen that I am not aware of. I hope it all works out for you.. Good luck.

by all means,fight back.it's all the high school kids' fault.the dogs will not attack them if they didn't trespass.there is a big sign posted at your fence,yet these kids dared to trespass.charge them back with trespassing.I know that dogs will not attack anyone just for the sake of attacking.they will attack once strangers get into the proximity of their home.

Hello rachaeltaylor84 this is checkmail and me too had an rpo with mine stray dog, one little black dog.Actually am not allowed to breed any dog in mine home, so mostly i have some stray dogs, there was one black puppy who was cute and also good at learning things.But as he got grown up he started an act of bitting uselessly.Even i tried to remove its habbit, but still he kept on going with it.He was much of an aggressive in nature and kids were afraid of him.So finally i left him far ways from mine place.Yeah think you too must leave them in animal care centre, its tought as well as rough decision but we have to make it.Even some times the better is served with worst.Hope you too understand what am explaining, Anyways Happy Mylotting.

Hi Rachael..so sorry to hear about your delima. You DEFINATELY need a lawyer. I know that they cost a lot of money but if you don't get one not only will you loose your dogs but it could be financially draining for you. They could put a lean on your property and the list goes on and on. My friend, this is a very serious issue. Call a few lawyers and get some prices and talk about a possible payment plan. I had to do that once and found that they were much more willing to work with me than I had anticipated. You could also try contacting Legal Aid, I don't know where you live but they are all over the country so look them up on line and see if there is an office near you. In any case, you have got to do something. Pit bulls here in Florida are illegal. They are looked at like mean killers and I know they are not. Any dog is vicious if you train it to be, but raise a pit bull with love and you'll get love back. Unfortunately, people hear pit bull and they freak out. Animal control could come right on to your property and remove the dogs for "observation" and if they see fit, they could put them down. You need a lawyer and you need one now..This could really be a huge problem for you but if you have them fenced in and signs warning people of the dogs than a lawyer should be able to squash the case with no problem. Without a lawyer, their lawyers could squash you, and your dogs. I feel for you as I know what it is when you love your dogs and someone threatens to take them away. Hi rachael taylor: first of all you have a lot of pets, it's fantastic and you must be a very responsable person to take care of your seven pets. I am not very sure how it's the legal stuff in your country but according to what i know it was all their fault. Your dogs were in a private area (actually your home) you had some warning signs indicating that you have dogs but i don't know what the other persons are saying against you and your pets. You better talk to a lawyer to defend your rights, that's what i have to say. Unfortunetly in every neighbourhood there are some cases of intolerance. Thanks for asking us for advice. I agree with most of the comments here regarding your case. You have a strong case, it was never your intention to harm those kids. Its just a pity that they ended up having those painful stiches, they should take responsibility of their actions. Better seek a legal advice for your protection.

Hello Rachel... I dont know much about legal stuff beside for when it is in Denmark where im originally from. But i know our rules are less though compared to the US law. If i had a fence on my property and a nice sign saying "BEWARE OF DOGS" they are obviously trespassing on your property doing something they arent suppoesed to and they should know the rules. Since the break the rules they should not be able to win a lawsuit against you because your dogs was just doing thier job. It would be totally different if your dogs broke out of your property and was attacking the teenagers. Or that you in some other way cannot control your dogs outside your own property where you may meet other people.

there is no way they will win. first off like you said they were trespassing. you have warning signs around your house which visible. so that is on them not you. now for neighbors not liking that you have all them dogs, do they bark all the time, if so maybe you should get them trained to focus on intruders rather then make all sorts of noises. for the court I don't see how you could lose, if you don't make that much money then you can be eligible for a public defender. but I don't how you can lose, you have the warning visible and your pool is not a public pool. you should sue them for pain and suffering see how they like it lol. but yeah good luck with that. sorry to hear that. sometimes people can be dumb.
