Who has the right of way?

I know when I am running that technically I have the right of way as the pedestrian. I don't usually get it, so I really am careful although frustrated! The other day I was running (on the sidewalk) and I met a bicycle. I moved over so he had the smooth surface, but I was thinking that really I had the right of way. He was considered a vehicle. Actually he shouldn't be riding on the sidewalk anyway! So who had the right of way, the bike or the runner?

I'm thinking you as the pedestrian had the right of way. Isn't it always the vehicle or bike that has to wait for the pedestrian to cross the street. I'm sure it was you and not the bike.

That's what I was thinking! But I was actually trying to be nice so that he didn't have to get off into the grass where he could wreck or so!

Frankly I think pedestrians take their rights too much for granted. You can argue with a bicycle anymore than you can - or should - argue with a car or truck. Pedestrians are responsible to LOOK for vehicles just as vehicles are supposed to look for pedestrians. You can't be sure that every driver will see you. Sometimes there are circumstances that make it hard to see pedestrians, especially at night. Let's be honest here. I've had many pedestrians just run right out in front of my car when I'm at a red light or stop sign and my head is turned to the left looking for traffic - and the pedestrian comes off my right and just keeps on moving without pausing for even a second. According to the police, a pedestrian is supposed to look at the traffic, even though laws always say the pedestrian has the right of way - you are still supposed to look too. It is so hard to see people walking or jogging at night - or even bike riders - that I'm always amazed at how those people just seem oblivious to the danger around them.

I understand. However, the pedestrian does have the right of way and if you do hit one you'll be the one with the ticket and the lawsuit! It pays to be extra careful. I do agree that the pedestrian has equally as much responsibility to be careful. I never go out in front of a car even if they are sitting at a stop sign or a light. If and only if they motion will I proceed!

You are so right bike riders have their own lane or they should ride in the street with the cars, in California its against the Law to ride on the side walk if I am not mistaken you can get a big ticket for doing that

Evidently there is no such law here! I don't know, I guess I could look into it. Not that it would help any! I figured at the time it was better for me to just get out of the way!

Truthfully...you answered your own question.
You've my dear most certainly had the right of way.
Bicycles are considered vehicles where I come from, and are not allowed to be ridden on sidewalks. The only stipulation we have here regarding that particular bylaw is...unless you happen to be 12 years of age or younger, then it's O.K. to do so.
However, anyone over the age of 12 riding a bicycle (or any other type of vehicle: wagon, scooter, skateboard, etc.) on the sidewalk, can and will be fined if caught.
...reason being: the city has graciously provided bicycle lanes, paths, and skateboard areas in which to travel.
Mind you, to date I have yet to see anyone being fined for riding on the sidewalk, let alone ever been "caught" by the city's "Bike Police", or anyone else for that matter.

Oh yes sir! I hear ya! The guy riding the bike was definitely over 12, probably more than two times 12!!I thought he should be on the road. There isn't a designated bicycle lane, however, it is a designated bike route which means that the other vehicles are to give the bikes the right of way! Ugh! What a vicious cycle!

Hello mac,
It's the pedestrian lane so,absolutely,you are on the right way.
bikers can take the extreme side of the road and not the sidewalks.
If the biker wants to take care of themselves by taking the sidewalks,
then,how about the pedestrians...aren't they also taking care of themselves?
I think there will be another lane for bikers to avoid little accidents.

I think there should be a biker's lane only for bicycles! However, if there is not one, the bike shouldn't be on the sidewalk. That's my opinion. The sidewalk here is running along a 4 lane road to begin with! There's not too much traffic and plenty of room for the bike to be on the road!

The pedestrian should have the right away, providing they exercise their common sense. After all, they are the most vulnerable, considering it is just themselves and no protection of any sort. There is always some person who blasts out of their driveway at a high speed that does not bother to look. Pedestrians should obviously look and cross the streets at designated points. Just like it would be up to the drivers to slow down at said designation points.
I do hate walking on sidewalks when bicycles come flying down there. I should not have to move out of the way. He should redirect his path around me. Some people just have no courtesy whatsoever. Then again, that's life, so I have no idea what I was expecting.

Boy are you ever right! It is a problem in society that we do not know how to yield. I am always careful even though I know I have the right of way!I'm like, why can't we just slow down a little bit and let the other guy go? Especially if we are the ones who are supposed to!?!

I think the sidewalk if for people to walk in not intended for any vehicle, my friend. Therefore, you have the right of way in that side walk than the biker...

i agree with you.as a pedestrian wo should have the right way to walk on,others like the bikers also need the same situation.we should respect with each other,otherwise,we are too small to fight against the big object,although the laws have the requirement,this is the society ,think widely
