Georgian Luge accidental death -- Self mistake or faulty design???

As most of you know, the Winter 2010 Omlympics start off badly with a faulty torch and a death. I was just wondering, was the accident due to mistake on the athelet or is is the fault of the designers?

I have not watched the video yet, however I managed to see the photo sequence.
To me, its a faulty design. They should have anticipated that the metal bars was a hazard, and they could have wrapped in with some form of padding.
There has been too many overlooked problems with the Winter Olympics this year...
