Hi there, I am an international student and my child was born in US and he is US citizen now. In my case, can I claim my child as dependence for tax return? I heard that for 2009, there is no benefit we can have from child under 16. I just want to know for a child (6 months old now), usually how much can we get from tax return for the child? And for what reason they cancel that benefit this year? Only for international student or for all US citizen?

hi kialele if your child is living with you and you are his sole keeper, yes he is surely your dependent, and yes you c an declare him as your dependent, anyone who told you other wise doesnt know what they are talking about. If you are a U.S citizen and get the tax forms and the instructions it will show you how much you get on tax return for your baby.As far as I know they did not cancel that at all, someone you overheard did not know what they were talking about.

Thanks. I just done a workshop for tax filing. They bought a software to help students to finish tax filing. And it shows in the software that there is no child tax return for 2009. I don't know if this is only for non-US students like me.

If your child has been living with you, and cannot be claimed as a dependent on someone else's tax return then yes, you can claim your child as a dependent. I don't know where you got the information you posted but that information is wrong. Not only can you take a deduction of $3,650 for your child, there is also an additional $1,000 child tax credit available. In addition, if your income was low in 2009, your child will qualify you for the Earned Income Credit which will increase your refund.
