I don't mind the cute little fur balls bouncing around the neighborhood, but I just got home to another piles of cat poop and paws in my garden, I just started my garden as well so at least I think I have a jump on preventing the cats from using it for a bathroom/ play ground. Any suggestions on safely putting something around or in my garden to prevent them from going in my bed of herbs.

I have seen a deterrent on a catalog website called gardens.com. It's a mat that has little spikey points sticking up so the cats won't want to walk on it. You could create a barrier with chicken wire that would lay over the herbs and you could pull it back when you need to.
One more is to buy a large container of chili powder that you sprinkle on the ground. The cat will snniff it and turn away. Some people suggest mothballs, but they are poisonous, so I would stay away from those.
