Two days ago I made a discussion regarding me wanting our company down. I talked to the manager about my resignation and I also demanded for my 13th month pay but he seems unwilling to give it. Its in the labor code that he is suppose to do that but he is really hard headed or maybe he just dont know what to do. Anyway, my friends in the company gave him a warning that if he will not change his mind about it, we are going to forward the complaint to DOLE and BIR. If this happens then there is a huge possibility that the company will dissolve cause they are doing a lot of illegal things.

Thanks! I think I am really going to get a better job. I just found out a few months ago that the tax we pay in this company is not our individual tax but the company tax divided by all the teachers so its like the teachers are the ones paying for the company tax.

Who told them to divided the company's tax to their employee? They are cheating on that part? This issue should be submitted in the higher authorities to take a look on this? Where are there little brains and if they dont have brains do they have initiative? Isn't the BIR are conducting a certain training about this?

I have a question regarding the complaint? How are you going to forward a complaint to DOLE and BIR? Is that by letter or you have to go to department? Are you going to pay for it? In my case the NLRC told me to make demand letter and if ever my previous boss failed to do his obligations it could be the start to complain but they told me to hire a lawyer. I mean of course I don't want to pay much for it since the problem here is all about the salary.

So if you go to DOLE and make a complaint about your situation, what will they do? Will DOLE sue the company? Do you think DOLE will be in favor of your complaints? OR they will make a background check of the company?

From what I have heard to people who had the complains before, they went to the DOLE office discuss the complains and they did checking for the legitimacy of the company and also with the complains. Listening to both sides, and suppose the company failed to do their duties then DOLE will do their part. The resolution in this case will favor the employees.

BabyEj is right guys! You dont have any idea about all the things that are going around here in our company. They already had this problem before but nobody made a complaint about it. We are going to be forwarding a letter to BIR and DOLE and we will ask them for guidance about what we can do about the complaint and to get what we want.

hi p3ks626 thats really not right as I just looked up what the 13th month pay was,its to help filippinos celebrate Christmas as a bonus of an extra months pay. its the law so why did not your employers just give it to you .Congrats on finally quitting your job as I know that was not an easy thing to do. I hope you will soon get a much better job wi th p eople who are compatible with you in the working place.

In the law, I think the Christmas bonus and the 13th month pay are two different things but the company only gives us the 13th month pay. But I am not going to ask for more, I think that's better than nothing.

Good to hear that. Im happy that you know your rights and benefits. That company should give you all the benefits you deserve. If not, go to DOLE and im pretty sure they will make good actions towards your complaint. Good luck on this and good luck on your next job. Happy mylotting!

When I am in the right track, I never hesitate to do what I am suppose to do. I also dont want other people stepping on me and trying to make me look foolish. I cant be fooled because I know the law and I am going to fight for it.

It's nice to hear you are happy now. Hope you have the same happy smiling face. I think you deserve a few days of relaxation. Sure hope you have tried to find a new job before you quit. Anyways, One question I got, wouldn't you think of the other that was left behind? are they also experiencing the same thing you have? how about them? will they just let the company continue do what they are doing?

@ Rene: I think so, are you suggesting that maybe p3ks is only the one who's experiencing it?...hmmmm, could it be? then it could be the employer's personal attack to her...which is more biased. Anyway, in the previous discussion she had " I want our company down" that she notified in the discussion she wrote about the whole picture of their company...this includes her colleagues.

@Rene: Most of the employees in that company are having the same problems. There are actually 5 among us who is very willing to work out for the complaint and the others will support. The only people who are going to have problems looking for another job is the company dissolves is the manager and the supervisor. I think they are really going to change their minds about giving us our benefits cause they dont want the company gone.

Congrats mate.You should always be happy with what you do and if you are not then it is not worth doing.Hope you get better prospects and you get to do something you love soon.I have been waiting for a long time to do something like this but my commitments do not give me the chance to do so.

I have been wanting to do this for a long time but I told myself I need to be more patient about it but the long wait is over cause they dont do anything. We tried to talk to them about it but they wouldnt follow what's in the law so we are making our own moves now.

Congratulations to you! I left a job about 8 months ago that I was not happy in and I am so glad that I did. I finally feel free and although I miss the money, I am enjoying the time I have had with my husband and my child. Enjoy your time home!

Speaking about the money, I think I am going to have a few months of holding on to a very tight budget but its better for me to have that rather than stay there in the company with the boss treating me and the others like we are not coworkers, he treats us like we are indebted to him which is definitely not.

What kind of illegal things they did? Oh my, you shouldn't have left like that. You have to stop them from whatever illegal things that they are doing! Anyway, congrats to you for leaving the unwanted job. It's no use working for a company which does illegal things, which in turn affect its workers. It's a lose-lose situation in the long-run.

I made a discussion about all the illegal things they do but I guess you were not able to read that. Anyway, they are not following the labor code. We are not entitled a leave, not even a sick leave. They wont give us our 13th month pay after we resign and they are taking money from our own salary to pay for the tax of the company.

That's good news p3ks. Actually, I was about to respond to your previous discussion. It's good that you decided to resign from your post, there's no good in slavering for a company anyway, but I'd also would like to strongly advise you to report your company to DOLE or BIR. I think that's the best thing to do. It will prevent this company to further abuse workers/employees in the future. Yes, it is indeed in the labor code of the Philippines that a 13th month pay should be given to regular employees. Also, about what you said that they're taking a part of your salaries to pay for their own taxes? That's obviously a fishy act. I'd also suggest that you seek advise from a lawyer, that way, you'd know how to handle the situation in a legal aspect. Also, make sure that you gather all the necessary evidences and people, as what the other lotters suggested. It's very important that you do this, so that you'll be on the higher ground during the battle ;)

We are on the move in doing all the necessary things that we are suppose to do in order for us to get what we really deserve and what we really need to have since its our anyway. There are a lot of people who are going to support and all we need to do now is gather the evidences.

Wow this is the first time I hear there is someone who love quiting their job. I think you must don't like to work at that company. I think you make a good decision if you really hate it, I think if you forced it you will lose passion to work. I hope you will find another job as soon as possible. Just enjoy your spare time .

ohh im so sorry that they dont want pay you for that month you worked. those people are too bad really.but tell police you and your workmates to see if they can do something about it. take with you proves that you work there. your contract. here in my country too. my stepfather and my mother worked for a man that didnt pay them a lot of money. he didnt pay more than 4000 euros to my stepfather and like maybe 2000 to my mother im not sure. my stepfather and other employees left and stopped work in that cafe restaurant and they closed it. now they opened it with a new partner and didnt even pay what they have to neither to my mother neither to my stepfather neither to other employers. i dont know how those people can even sleep :( that man has many lawsuits on court but still he is happy using the money that is not his :( wish you have that solved soon^^ the money is yours so they must give it^^

There is a possibility that the company will also close and stop operating once the authorities find out about all the illegalities that they are doing. All we want is for them to give us what we're suppose to have and they said they dont want to cause the company lawyer said there's should be none but the law states there should be.

wow, I would support you friend... as you are just doing the right thing, of course we should exercise our right... they must pay us accordingly you know... and provide us all the applicable priveleges and the like... every compnay must treat us as very valuable part of their business... it is sad to know that there are still companies that deprived many of there employees to all there rights... if we are strong enough though to put this into action, this would not likely to happen in the future... I feel sorry myself. We also dont have a choice but settle things legally cause the company doesnt seem to care about our concerns. We are the only set of employees who made a complain about this so maybe they are thinking that we are just going to chicken out.

Congratulate! I think you have take the right move if you do not like your ex-company. It call "ex" because you have resigned from the company. I hope your complain to the DOLE and BIR will work and get back what you deserve to get. I did that with my previous company too, it was too pressure to work in that company. I believe many of you have heard of the Foxcon in China. My ex-company was similar to that company. I was mentally tortured in the company and I have work only up to 6 months in the company and I quited because of the crazy work load and crazy working hour..almost every day more than 12 hours and the higher working hour I have hit was 35 hours...phew! That was like a nightmare for me...

The ex company was also like that. They are also requiring me to go to their office even if I am not doing anything there. The only reason a teacher could stay there is when she is having her classes then after that no more. The company wants me to stay there even if I am not paid for it. I think the manager is really crazy.

hi p3ks626, congratulations to you on your new found happiness!! Perhaps it was not a hard decision to make. For the 13th month pay, I think it depends on whether you have fulfilled the full-term of the contract or not. So that may be a "gap" here.

The law doesnt say "it depends if you have fulfilled the full-term of the contract". The law says that we are entitled to have our 13th month pay even if we resigned, terminated or what. Maybe you read the link? And we have talked to DOLE already and they said we should have.

Its Online English International Corporation. They have a website but they are catering 3 websites. Its online tutorial for Koreans and they are suppose to bring only one website in a company but this company has three. I think that's also illegal.
