Can you go to jail for not paying your credit card bills?

For the past seven days, I got two friends who asked me the same question. They said the Collecting Agents and the lawyers of the banks have been bugging them and making threats. Obviously, they were bothered with the idea of going through litigation and finally ending up in jail if they cannot pay their credit card bills. I'm just wondering if these are mere strategies of the collecting agents. Do you somebody who really and actually went to jail for non payment of credit card bills?

Collecting agents are rude and to some extent would resort to threats why? because they get something when you pay. I think most of the amount goes to the collecting agents. there was a member here who posted that a credit card debt will be considered by the bank as "losses" if it's not paid. If this happens, the bank moves on and transfer the debts to collecting agents. If this is the case, think collectors get the bulk of the payment you'll make. I heard that you can even haggle with the collecting agents on how much money you can pay which means that they're in control of the debt already and not the bank. The problem is, when you have a bad credit rating it's not going to change and you'll be having a hard time getting loans even if you pay your debt.

That's so true. You may may not be compelled by Collecting Agents to pay your Credit Card bills but the banks can have your name blacklisted. As a result, it would be very very difficult to apply for loans thereafter. Thanks for the response ybong007.

We don't have debtor's prisons any longer, so you cannot go to jail for not paying your credit card bills. Probably what will happen is that the credit card company will sell your debt to a collection agency. That collection agency will then start harassing you for the money. Your friends need to do some research on how to deal with collection agencies. Above all, don't pay anything to the collection agency until you have proof in writing that they have a right to collect this money.

No emgee595 they will not go to jail. Their credit will be ruined (which if bill collectors are hounding them so much their credit is already ruined)! Collection agents are a different breed of human. Be rest assured that they are hot on the trail of the debtor and being just as rude to them as possible to scare them. Recently a friend of ours told us that a collector had his wife on the phone in tears threatening such horrible things, they were going to be homeless if they did not come up with the overdue payment immediately. Mind you they were only 5 days late at this point. The husband called the agent back and told him to come and get their property and when they got there they would not recognize it. Of course the collector backed off and made arrangements with them. Collectors will hound the person in debt and every person that they used as a reference will be hounded as well. They will call your job and anyone they can get the number for to harass you enough to get their money.

I like that funny statement about going to jail if you kill the collector :D. Kidding aside, the reason why collecting agents, the ones who call you over the phone almost every hour in a day, are rude is that they work in a call center and are given certain percentage if they can scare the hell out of the debtors and make them pay for their debts. Credit company won't go to the hassle of filing a case against in you court as they don't want to spend huge amount of filing fees. Besides, each credit card they issued has insurance to cover bad debts or credits which they could no longer collect. Trying to mess your life up with their calls is just one of their strategies to make you pay. On your part, on the other hand, it would be better to be responsible enough to pay what you get on time otherwise, don't go on a shopping spree with the use of your credit card.

I also had a great laugh when I read the reply about killing the collector. It still make me chuckle now. I agree with you. The cost of going through litigation will not not be offset by the amount collected if the bank or the collecting agent will pursue the collection case in court. Though a card holder may not be compelled to pay, it still pays to maintain a good credit standing. If only my friends can read your replies here, I bet they will heed your advice. Yes they cannot jail you, they will just use their "hound dogs" a.k.a. collecting agents and lawyers do the dirty job. hehehe...thanks for the reply guys
