Yes! That's what we found out a few months ago. Our company deduct a certain amount of money from our salary for the tax thinking that it was our individual tax but sad to say the company is collecting money from us to pay for the their own tax. I think that us really illegal and one of my co worker wanted to make a complaint about that cause she thinks that she has been cheated on and she didnt like it. Well, who would like, right? But I just wonder, what's in it for us if she makes the complain. Do you think there is a possibility that the company will give us back our tax?

I think in this case, it is better to get someone professional like lawyer to involved into it. I think your ex-company is trying to squeeze as much as from you all. Since the company dare to do this, I believe they must have huge backup like someone in the authority or some politician that support them. They will not entertain you who are just a small fish for them. If you can gather all the workers and make it a hot news in the paper, and get more attention from the public and this will help. This is just some suggestion that you can refer. But the best way is to look for someone in the law field like lawyer to handle the issue, that will be more efficient.

It is the paying back time for your company. I think now they will start to panic about all these thing, some of the company will think that they can take a portion of their employee money without them realizing it. But actually not, many people will actually check their money in detail, when they find out about this, then, it is the pay back time for the company.

I think you should consult a legal adviser who is competent with handling organization and tax issues. The reason is that this thing depends on the laws prevalent in your country / province / state. However, if you jump into direct confrontations, you would never be sure of what the results of this would be. They can even sack you of your job to make the matters more complicated.
But, yes, I agree that what your organization is doing is unfair and should return you the amount it has collected under the Tax head.

It is good to know that you are careful with this and would be considering taking professional suggestions from people who are more versed. As far as the firing from job thing, I feel that if the organization was misled, things would be merrier and there would be no need of resignations.

My coworker said she just wanted to go to the authorities and ask about the proper way on how taxes are taken from employees and how the company should pay for it. We are also planning to go to the public attorney's office for this but as you said, we have to make sure. We also dont care if the company is going to fire us or something cause I already passes my resignation letter and there's no need for them to do that.

How did you know that it was set for company tax? Until the company remits the tax collected, it would be premature to conclude for whom the tax is collected. After the company remits the taxes collected, they will give you a refund. Be vigilant about recording how much they deducted and remitted. Or look at your old payslips. The company cannot make the employees pay for their taxes.

We found out that the taxes we payed was for the company tax when one of the administrators said that that was what the company was doing. Of course we were not happy about it cause they should have payed for their own taxes. It went down to the idea that we didnt pay our taxes at all cause we were doing it for the company but we didnt know about that.

As an employee you still have the obligation to pay your income tax. So if ever the company decide to remit it to the BIR. The only excess of the tax from your taxable income will be given to you. If not, i think you have to demand the company to refund the tax deducted from your salary and manually remitted it to the BIR. You can ask the Revenue Officer to assist you. Good thing someone can help me with this concern. I am not really very sure about how these taxes are being imposed. As far as I know, the company where I work for deduct money from our salary as to pay for the company tax. Our salary is less than 10000 pesos and I believe those who earn less than that should not pay for tax. This is not the first private company I worked for. The other companies payed for their own tax and not us paying for their taxes.

There is a possibility that they will give it back to you as long as you give them a valid reason that what they've done (collecting money from your salary as tax) is illegal. Just prepare for the consequences like being fired :)

I would also like to add an example for a valid reason that you can give is going to the tax bureau and asking for advice/solution whether what the employer did was right and how to approach the problem in a way that will not jeopardize your position in the company.

They dont need to fire me cause I already quit. Its just that we want justice and we dont want the company to do that to other employees. We are really planning to go to the bureau of internal revenue and we are thinking that if they find out this is what our company is doing then they are going to be upset.

Hi,
This is a typical procedure for private players. If you are working in some private company I don't think you stand a chance. You may try to motivate people to come together to protest against the company rule. The practice of cutting service taxes in order to pay The Government is not new in these companies. The legitimate effect should be a tax free salary. Before taking any step you must first study the company policies. If there is an abstract terms and conditions then you have to take help of Law. Talk to the lawyer of the company if there is such a rule that allows the company to deduct money from your salary on this purpose. Consult other lawyers, who deal with income tax. Then take your decision if you really feel like going against your company. One thing I can tell you for sure, that this is gonna be a bitter and prolonged battle against your company. Thanks.

Yes! You are also right about that! I think that would be helpful as well. But I wonder if we would even have access to the lawyer of the company cause he only talks to the manager and the manager doesnt update us about anything. I just know one case wherein the BIR didnt allow the company to operate anymore cause they had the same situation, employees paying for the company tax. So I wonder if its going to be the same with what we want to happen here in our company.
