I'm currently working on a thesis on Data protection in US and EU relations and I was wondering if there was anyone that could suggest some websites/books or whatever to help me out on starting my research. Keep in mind they have to be reliable sources, not simple forums where anyone can say whatever. Possibly something updated and with vast amounts of information. Thank you everyone for any contribution.

I can't help you there, but I know all the privacy laws have been a pain for me. I fully understand that they are meant to help. However, my son is incapacitated in an automobile accident. I was trying to pay on some of his school loans but they can't even talk to me about the weather.. all because of privacy. I can't even get how much money they need for a payment.. so I tell them to just eat it then... there needs to be some exclusionary factors in there somewhere. They keep sending him this "release of information to third party" forms... I keep telling them he is not able to sign the forms or even be aware of anything. it's been frustrating! So.. sorry can't help you out!

If he was with it enough to grant power of attorney he could handle the bill collectors. I contacted a lawyer because I thought that he might could offer some assistance with the loan companies... but he wants 150 bucks just to talk to me...

I will check out the disability site. I am not in Illinois right now though. I brought my son to Oklahoma so we could be near family.
I have looked into guardianship. However, it is useless as the school loan people won't recognize it. It has to be power of attorney or they will not speak with me. I already get his SSI and so I am already in charge of his money, perhaps there are other benefits to guardianship I am not aware of?

Okay i looked into it, now since I dont have all the fact the best I can do is make some assumptions, I apologize if they are incorrect but I would never ask you to divulge personal information. I assume that the school thins you are refferring to what is called a 'natural guardian' which would be you, the natural parent. This obviously does not entitle you to act in any way in the name of your son. What you are looking for is 'guardianship of the person' which will allow you to decide on your son's behalf on matters regarding his medical care, his living arrangements and to closely monitor his needs. The other type of guardianship, which, by what I understand, is wha you actually need is to be 'guardianship of estate'. This particular guardianship allows you to make all financial decisions (e.g. pay his bills, which he obviously can't). Keep in mindo tho that the process is cumbersome and somewhat expensive (main reason why I suggest to look into pro-bono). A judge will hear your case out and determine if you are to act in his best interest, the judge will also verify that you understand all the relative responsabilities. There are a lot more things but given the father/son bond and the process might be somewhat easier. If you are only looking to pay that one bill I would also suggest that you look into being appointed as a limited guardian or short term guardian, giving you permission to act in his behalf for only specific tasks. This would simplify a lot of things.
Again, i would like to remind you that I havent studied in depth US law, so I can only make statements on what I did study. Your best bet is get a pro-bono lawyer who would simplify things for you.
If you want all the neccessary onfo then I would strongly suggest you read (755 IL CS5/) Probate Act of 1975 which currently controls guardians actions.
Believe me if you are a court appointed guardian (be it short term or of estate) then the school cannot not recognize it.
