Who is wrong????

Today when I am returning from college, I saw a accident in the middle of the road many people gathering there just shouting and few are crying. After going there I saw a man was lying dead who was smashed by a Truck. When I ask them how all this happen few are telling that the truck was coming at a speed of 80km and at the same time the person was crossing the road and smashed by the car. So what do you think who's fault is it the dead man or the driver of the truck??????????

Hi. ashish3090. It is very obvious that it is the truck driver's fault. What was the normal speed limit on this road? If this truck driver went over this number, then he was speeding, no doubt. I could not imagine ever seeing something horrible like this! When the police are on this accident scene, he may very well be arrested for killing this man. Even if the man was not looking as he was walking on the street, the truck driver should have slowed down when he saw this man. Driving too fast is very risky because it would be hard for someone to just slow down when someone is crossing the road. That is why it is very important for all drivers to maintain a certain speed so that they don't have to end up pressing on their brakes so fast to avoid an accident. I am very sorry about what happened to this poor man.

I don't know. I just wonder whether there is a traffic light there. And besides whether this man went across the crossing according to the traffic light? This will be the point to judge who should be responsible to this accident. But anyway, it seems that a truck shouldn't drive at a speed of 80KM in a city. It shall be speedy in my opinion.

Really hard to say without more details. Did he dart out in front of the truck, or had he been walking slowly and the truck driver just wasn't paying attention? Did he come out from behind a car? Was it dark and he was wearing dark clothing? Was he crossing legally? Was the driver exceeding the speed limit?

I always wondered why here the driver is always at fault, perhaps because the law looks at it as a driver maybe going to fast and not allowing time to be able to stop for pedestrians. So in this situation it is difficult to say because was the driver going way too fast to cause negligence on his behalf. Or did the pedestrian cross in harms way in the middle of the road putting himself in danger.
kind of hard to tell unless we actually saw and or heard the driver side/witnesses side of what actually happened.

Sometimes pedestrians are also to blame as there are people who just crosses the street even if they know that its unsafe. There are also times when even if the traffic light is green, pedestrians are rushing to cross. I guess there are also times when its the people who crosses the street who's at fault. What I do not like sometimes is that people always excuse that the one with the car is at fault because he or she is at speed. When people are just making that as an excuse. So even if the pedestrian who is at faukt, they will blame the one with the car.

Both of them are equally wrong and alongwith them, our highly demotivated, ill-trained and poorly manned traffic management. Almost everywhere in India it is the same scenario…we as the people are completely irresponsible on the road. We can never wait for the lights to turn green, we never walk across to the zebra crossing, we jay walk and we cross the road from wherever we want to. Similarly, most people with cars feel as if they own the road…truckers and highway drivers are worst. Since they drive thru relatively uncongested areas, they have very little patience on congested roads. There was a proposal (at least in my city Kolkata) not to allow truck and other heavy vehicles to ply the roads between 8am to 8pm but like everything else, this too has never been implemented strictly.
I sincerely feel that traffic rules and road etiquette should be taught in all schools for a sustained period…no exams, just hammer the facts and discipline in the minds of kids so that when they grow up, they at least will try to follow some rules.

People dying on the road hit by the speeding vehicles is a common phenomenon world over and specially in the developing world. The first reaction to this is to blame the driver and rightly so as the driver has to be cautious and driving the vehicle at a speed which he could control at the first glimpse of any leaving object on the road. Most of the times the vehicles are seen to be driven at the speed they can not be controlled. Another side to this incident is that people crossing the road should confirm that it is safe to cross the road before they put a foot on to it. The city authorities should also take a part of the blame for this as they have not got adequate legislation and safety measures to prevent such incidents.

There is a saying here in Sweden about driving any vehicle, you shall drive in a speed to be able to stop if anything is crossing your road. So the driver of the truck is responsible for his speed and was not able to avoid the accident runnning over a human being. The same goes with horses. Are you driving on the road and horses or a rider on a horse is suddenly in front of you the driver should have a speed to be able to stop to avoid a accident. The same goes with children running out in the road. A driver has the responsibility.
