Background: My husband has a bill at a hospital that is owned by the state. It is not a bill we were supposed to have paid, but I cannot get them to understand that. This brings us to today. I received a letter saying that my state income tax refund was being kept to go toward this bill. It says that I may be able to file as a non-liable spouse and keep the portion of the refund that is what I paid in. Since I am the only income and all of it was paid in by me, I am interested in doing this. I have looked everywhere and can't find the definition of non=liable spouse, only that it means I am not liable for the debt. We were married at the time, but it is for his medical care. Does anyone know if I would qualify as non-liable spouse? We live in Ohio.

Although I am in IL I can tell you that during my divorce his medical bills could not be included in the divorce decree, this can give an idea that you should be able to file for the non-liable spouse as well.
