Washington (CNN) -- A federal appeals court has tossed out key provisions of the sweeping health care reform bill championed by President Obama, setting up a likely election-year showdown at the Supreme Court over the landmark legislation.
A 2-1 panel of the 11th Circuit U.S. Court of Appeals in Atlanta on Friday found that the law's "individual mandate" section -- requiring nearly all Americans to purchase health insurance by 2014 or face financial penalties -- was an improper exercise of federal authority.
"The individual mandate exceeds Congress's enumerated commerce power and is unconstitutional," Chief Judge Joel Dubina wrote. "This economic mandate represents a wholly novel and potentially unbounded assertion of congressional authority: the ability to compel Americans to purchase an expensive health insurance product they have elected not to buy, and to make them re-purchase that insurance product every month for their entire lives."

I want to know people's opinions. I just want to know opinions that is all I am asking for. I am not asking for arguments.

I agree with the Circuit Courts decision today. I do not think the government should have the power to force people to obtain health insurance. Having said that, I do think we need health care reform. I do not think the ObamaCare plan is the answer though. I think we need to repeal that bill and start over, slowly. I think we need to start with the most important aspects of our health care problems and reform one area at a time. Personally, I would start with ensuring that people with pre-existing conditions cannot be denied and that they have to be given a fair price for coverage. I think the ObamaCare plan is too complicated and it is scaring many in this country. I think health care reform is absolutely necessary, but I don't think it should be done as forcefully as it was.

I never agreed with most of the provisions of the new health care plan. My husband is retired and on Medicare and I can tell you that doctor visits, prescriptions and virtually everything that he has to pay out of pocket doubled as a result of the new legislation. I do wish though that there was something that could be done in this regard. When people don't purchase health insurance and they have little or no assets, all of the rest of us pay for their medical care.

A case in point. When I retired, my employer sent me information on the insurance that was available to me under Cobra. The cost for my husband and myself was $950 per month! Who can afford that? What is so sad is how do people who have lost their jobs as a result of this economy that none of the politicans can seem to fix pay for healthcare out of their unemployment checks. Absolutely ridiculous. Every other western government has been able to create a plan to provide universal health care yet the U.S. cannot. Probably because the Democrats and Republicans are too busy fighting and perpetuating their own self interests to create any meaningful programs.

I think that it's a great idea because we need healthcare, but I think that it was poor executed. I think that there are a lot of flaws in this plan. I also heard Obama stating once that it would be affordable, and so far that does not seem to be the case. Again, this Healthcare Law is a great idea, but it needs a lot of tweaking.

Hello o2. I am glad that the court tossed out that key provision. Personally I would like to see the whole bill repealed. It was pushed through without letting any one read it. Palosi Said it has to pass to find out what is in it and that totally wrong. Now I know that something needs to be done about health care but not this way. This bill is one reason employers are not hiring because they don't know how it will affect them and their bottom line. As more is found out about the bill it cost is becoming outrageous. With the debt we already owe to China we can't afford it.

to have a healthcare plan that competes with other health care plans maybe not an idea that's approved. lower income families that couldn't afford blue corss will be able to afford a low budget sobra that only helps a few things. Insurance covers prexisting suggestions is expensive to to consumers.

I never liked the health bill because for one thing, it was over 1000 pages long. No one was quite sure what was in it but Congress passed it in a hurry anyway. I also don't know if I agree with the ideological that pushed the health bill. Secondly, the expense of the new health is outrageous. To add to the expense of the health industry just burdens the people more. I really think our President failed us with the health bill/
A democracy is about the ability to chose. If we lived under a monarchy, then I can see the government demanding everyone purchase health care. However, this is not a monarchy. Furthermore, how do they expect the poor Americans who ware living on $500 or less a month to pay for forced healthcare? I am glad the court made this decision. I hope the courts will evaluate other parts of the bill in the near future to.
