An Update To My Situation With My Job

As many of you know I have been having a lot of issues with my job to where I have had to file complaints with the American Diabetes Association, with my Doctors, and now the EEOC as well as talking with a Lawyer. It has been an interesting situation and in reality, one that I would never wish for anyone else. There are things starting to happen with this, and I am still stressing at times but nothing like I was, and know that things will work out in time. Just not sure how. Personally what I am finding out is due to the Economy being the way it is, this is the reason why most people especially Newer ones have no real foot to stand on and are afraid to say anything. But since I have been there now for just over 5 yrs. it actually is shocking them that I am complaining and they were thinking I was a timid quiet person. But after turning the paperwork into the EEOC the boss was shocked I said anything. It just still has been a roller coaster of events with so much going on I really wish I knew what was best. Actually can someone give me about $1600 a month to where I can just leave my job and not have to worry about this situation anymore? That would be easier, but then not solve the real issues there. Just really wish something better would come along for employment before this is over to make my life a whole lot better. Would you believe he told me he would write me up if I did not show up, even with a Doctors note? Then he also said that he did not have to follow Dr's notes, etc. and was even not wanting to believe that these were real. So I filed the paperwork with EEOC and they sent in a thing to my Boss letting them know a complaint had been filed. I was asked what Discrimination charge, etc. And then he was speechless like saying we never discriminate against you. But I then told him I was not coming to work last Friday as I had the Doctors note, and so he said he would switch my hrs. I now have Thursday and Fridays off starting next week. Would have been easier due to my living in Tacoma and working in Seattle to have Friday and Saturday but I guess this will work. He gave someone who has been there 1 yr. less than me I think the Friday Saturday. But I did not get my Vacation pay for last Friday and wondering if I will get paid for not working tomorrow? I might need to make a call to see if you can get denied a Vacation day of pay... (He denied my FMLA saying he does have to Honor that, so who knows.) Personally I am still trying to find a job somewhere else, and really hoping something better in time does come along. It has been an interesting situation, and overall one I would never want to trade anyone else here with for sure. Just one day I know it will all be behind me, and everything will be OK. Just Praying and believing as many of you are as well, that this can be someday soon. ~~TINA~~

Well I do know that I am looking for a New job still, and will continue to be looking until I do find one. Right now I also need to make sure that my Medical situation is going to be under control, because unless a Miracle happens once I get a New job I will be without medical for at least 3 months as well. So for now maybe even with all the problems, it is best to stay where I am at.

Atleast he is working with you alittle. I guess I take it you didn't get that job where your husband works-? That would have been too good to hope for. Hopefully you will find something else that you like and that will work better for you. Seems like things are smoothing out though.

Well right now I have quit looking for another job until I know my leg is better. I know that God is in control and things will keep on looking up from here. Maybe not 100% like I would like, but they are better.

Let's put it this way, things have been better. Still waiting to see on the Raise issue, etc. as I did turn in another reminder note, but found out some interesting information as well so just waiting until after payday to see how I need to proceed from here. But if anyone else wants my Job they can have it. Just let me keep my Medical until my Leg is completely healed.

Tina, have you tried going to employment agencies? My son was out of work for about 2 years, then found a part-time job which he had for a few months before he lost his roommate and had to move back in with his brother, way too far for him to keep that job. He was out of work for almost a year before his brother advised him to try employment agencies, even temp agencies. My son is now on his second day of work and, even though he is actually working for the temp agency, he has what looks like a really nice, long-lasting job. They asked him if he wanted to come in tomorrow, which he doesn't have to, because they like the way he works. The thing is, he went to the agency on Friday, came back on Tuesday for orientation at the temp agency (Monday was Labor Day) and started working on Thursday. This is after searching individual companies for a year! Try a temp agency. I think you'll be pleasantly surprised and you don't have to work on the days when you have doctor's appointments. You let them know when you can work and when you can't.

Oh, almost forgot. Some of these agencies have health insurance benefits. If not, you can always keep your health insurance that you have now through COBRA.

Well, as they have switched my days off now to Thursday and Friday I have my Fridays off for the days that I have Doctors apts. and that is working good for me. I miss having my Sundays off, but doing what I got to do for now. After filing the complaint with the EEOC things have gotten a lot better. Still have not gotten my raise which is not a Good thing, but things are a lot better for sure.

It is good that you got the day off you needed to have and I wish you all the luck with finding a new job! It is a shame when some bosses don’t do the right thing for their employees and it is good to see that they cannot get away with it especially when they don’t offer good working conditions in the first place. I hope you are paid as you should be too.

Well still patiently waiting as I turned in another reminder request about my raise and will see if it is reflected on my paycheck on Wednesday or this needs to be reported as well. Personally I am finding out a lot of interesting things and I am sure if he is really thinking he will have that raise on there. If not, well it is beyond his control what action happens from here.

Hang on in there Tina! Mum was often touted as someone who was timid and afraid of authority but looked what happened to her! Threatened her employers with an Employment Tribunal and, Hey Presto, she has her job back..not the one she had before but it IS work and she IS able to carry on for another 3 years. I shall ring her later to find out how her first week has been. You also know you're in the right, which helps enormously.

Well I know that I am still sure my Boss never suspected I of all people would ever do something like that, and instead would quit and save the company a lot of money. It has not been easy, nor some of the issues have not all been resolved yet, and probably never will, but I think it woke them up a little to know someone is paying attention to what the rules need to be.

That's cool that your boss seems to be working with you more. Hopefully he continues to do so. Hopefully everything ends up getting better for you and that you can find a good job with good medical benefits.

Well I know as much as I would Love to be at a different job, and everyone her would Love to see me working at a different job, for the time being maybe it is Best to stay where I am at. I do have the wound on my right leg that is not completely healed yet, and I still do need the Medical. For now things are going better. Waiting to see next Wednesday when I get paid if things are completely straightened out yet, and then go from there. I still have the complaint open if there is not a raise on next check etc.

I can tell that you are much calmer now that you have confronted them and filed your complaints. Things will work out. I do wish you would find something closer to home, and better. Keep us posted.

Oh how I wish I could find something closer to my home as well. I think God is keeping me at my job due to the Medical since I have Medical insurance due to making sure I can pay for this wound care and then as soon as this is over maybe something better can come along. I would Love to work closer to home and get this situation really behind me, but nothing is there just yet. Have had 3 more interviews just this month, and know in time something better will truly come along.

It's hard to imagine this working out for your good, but we know it will. Maybe your experience and you filing a claim will help someone out in the future who works there. And hopefully you'll get a job that is best for your health and finances.

Well for now for some reason my leg is being stubborn in wanting to heal all the way to where I can consider going and applying and working somewhere else, so for now I have no choice but to continue to fight on everything and hope for the Best from the end. My days off are now Thursday and Friday, but there still are a few more issues needing to be ironed out for sure. Hopefully with the complaints to the EEOC etc. is waking the company up a little to be more on their toes from here.

Well I am sure you are well aware due to all my Health issues, I am patiently waiting it out to make sure that my leg is healed before stepping out into something else for work. And since I think this leg is wanting to be stubborn now I guess god is trying to teach me patience as well. And since I made all the complaints, things have been a little more calmer as well.

I'm so sorry you have an a**hole for a boss. I'm tryin to hang in there for 1 1/2 years so I can retire. I'm not working due to illness right now, but in a couple of weeks, I might be able to go back to subbing in a school district. We shall see. I wish the economy was better so you could get a better job. Right now it is so bad that most employers think they can do anything. But the laws are still in place. Hope your job search gets brighter. Hope all our lots in life improve. Take care.

Well for now due with the situation with my leg, and the Chronic wound, I am sticking to the job I have. Things do seem a little more calmer there now, just have not gotten the raise I was supposed to get though, so needing to add that to the complaint as that is not legal. But other than that just waiting it out. My one note said I would be late only until October, and that is next week and my leg is not healed yet, so I might have to get a more updated note for this situation as well. But at least it has calmed down some.

I am sorry, Tina. I do not know your entire situation. Sounds like you have an illness that is causing it to be tough to work, and the boss is giving you a difficult time about it. I wish I had money to give you and many others monthly, but I just don't have it. I pray that something good works out for you with your health and another good job. Hang in there. It will work out.

Well, it would be nice if there was an easier solution. For now, this is the solution that is going to work out Best for me. I am trying to find another job, but due to the Medical need at this time I am probably best where I am at even if things are not always the Best. I am just hanging in there and know God is in control.

I am glad that your boss is finally working with you, unfortunately my husband got fired on Tuesday and now is out of work. If he does not find something by the end of next month we will be moving to Las Vegas. I cannot believe that your boss does not honor your doctor's notes and we can understand that first hand because my husband's former employer did not allow my husband to take the day off when he needed to go to the Veterans Hospital in Salt Lake (we live 4 hours away and it is impossible to know how long my husband will be). I would think he should give you your vacation pay, but I would check. I hope you find work soon at a better place where you can be respected.

I hope by now things have gotten a little better and your husband has been able to find work. Seems like the worse the Economy gets, the worse bosses are getting, and less understanding and judgemental for sure. You would think more bosses would want to work with people instead of having High turnover rates, and more costs associated from that, but you never know. Will be Praying for you my friend.

Hi Tina! What a bumpy road this boss of yours has made you undergo. Simply because he feels he does not have obey laws. I have you in constant prayer my friend and know that someday soon you shall get this all behind you. I really can't believe that he has gone so far, but am glad you did file this paperwork as even though you may not be there someday, this kind of mistreatment has to stop for all others too. Well, right now I have the Medical still especially after making all these complaints, and even though I have not gotten my Raise, I am somehow believing God he has me where I need to be for now. I would Love to be working somewhere else and get this all behind me, but my Boss could be stopping this when other prospective employers call, and also my Medical situation with my leg needs to be healed more as well. But in time, in time... I know God is still in control.

Hi Tina, I'm not sure what FMLA is, but he must have asked a lawyer or something if he had to honor it. I hope you get your pay. I hope they don't try to mess you up when you look for another job.. i mean by references. I don't think they can bring up you filed discrimination suit against them.. or anything.. but if they do... you might could sue them for that if they try to black ball you for getting another job.

Well, since filing with the EEOC things have gotten a lot calmer at work as he knew I was not fooling around. I still am waiting for my raise as I posted in another discussion and it might take a fight to get that, but personally when and if this leg ever decides to completely heal it will then be time to move on. I know this is not the worst job I have ever had, but a challenge for sure.

Hi Tina, I'm glad you are standing up for your rights (and the rights of anyone else who is in your situation)since your employer is being like that. He might think his actions are not discriminatory, but he has to realize that sick people have rights too. Keep standing up to him and eventually he will see the light. I can't believe he said he doesn't have to honor a note from your doctor. That is the main reason you get them, so that yur boss will believe you. At least your wounds are shoing some improvement even if you still have the same job. Just keep looking and you will get a new one, hopefully sooner than later.

Well for now until the wound is healed, I am sure that is why all the jobs I have been applying for, nothing appears to be the right one for me. Probably as soon as this wound is healed, something will open up, and for now I really do need the Medical. It did floor me as to him not believing the Doctors notes, etc. but after making the complaints he switched my days off and that is OK for now.
