Wrongly Accused

So about six months I had my first run in with the law, however I had done nothing wrong. My boyfriend at the time and I met some friends at the bar and I had a girls night and he was there just to be my DD. It had rained A LOT that day and on our way home there was about two inches of water on the roads. Because I was highly intoxicated, he was the one driving home. He was 100% sober! Upon arriving home he hydroplaned and we went into the neighbors ditch, over our driveway and landed in our own ditch. The cops were called because of a crashing noise and they showed up at out house about 45 mins later in which then I was arrested and fully charged with a DUI. Now that I have told my story, I would like to know if anyone else has been wrongly convicted of any crime and what your story is.

Wow...thats messed up. I think the only time I've ever been wrongly accused of something was way back in high school. A friend and I were skipping school and shopping in the dept.store in which we both worked. Unbeknown to me, she shop-lifted a stupid item that we could easily have bought. I really didn't know she had done it and was shocked when security stopped us on our way out. The police came out and worse yet...our parents got called. No legal trouble as we were minors but I did lose my job and got grounded and also got in trouble at the school for skipping. My friend did NOT lose me as a friend for some reason. almost 40 years later...we are still best buds. In fact she should be here any minute now. Sounds like you have a ridiculous judicial system. The lawyer should have been easily able to get your case dropped. You were NOT seen behind the wheel.

Oh it was so long ago that I don't remember if she said anything to try to help me out. I almost think that she did. They wouldn't have listened anyway.

That sucks that you got in trouble too even though you were totally unaware of it. Did ur friend say u didn't know? And that's good you didn't your friendship over that. Good trustworthy friends r hard to come by.

Well that sounds a little messed up in my opinion. Did your boyfriend tell them that he was driving? It does look bad because your car might have been damaged and then they probably dug deeper into all of it saw the car might have been registered in your name so its your car and your the one that should be driving it and your drunk so it doesnt look good on your terms at all. If you dont have video to prove your innocent or a picture that he was driving with a date stamped on it then your going to be charged with it because of my statement above. I have never been in trouble with the law except getting tickets.

They had NO proof that I had been the one driving the car. Cops can do and say whatever they want to and because I am so young it was my word against his. There is no such thing as innocent until proven guilty because no one proved a thing in my case and I was still convicted

I am sorry to hear this but not surprised in the least sorry to say. The law is just not what we would hope it to be. Two members of my family have been wrongly accused and convicted of crimes they did not commit. Tearing apart one family bc he was sentenced to prison for life too. And then another person was pressured into pleading guilty so now its nearly impossible for him to get a job. If you arent able to pay a bunch of money to a lawyer, you will get what they want to do to you. ~C~ er

First off, I have never had anything like this happen to me. Secondly I hope that you fought the charges in court. If you were not driving YOU cannot be charged with DUI. The police would have first had to give the DRIVER a blow test. Since you were not behind the wheel, they do NOT have the right to charge you. If your driver was 100% sober, they wouldn't have a leg to stand on in court. If you are still having trouble with this case, I would suggest talking to a lawyer as there are some out there who will give you Free advice and in your case I think that you would benifit from it, and so would your BF. I hope that things work out for you as it is NEVER fair to be wrongly accused of someything, and that is just what is happening to you. Good luck and happy mylotting.

No body was in the car when the cops arrived. The person that called them on us said it was two girls n because it was just me n my bf there when they arrived they assumed I drove n he was already home. I did pay a lawyer but as I said in previous responses there were issues when they drew my blood so I had to take a plea

That is terrible! The police officers where you are must be looked at like they are God or something. That is how it sounds. They should have listened to you and believed your boyfriend! It's not right that they can say and do whatever they feel like doing...I'm sorry.
