My friend got accident, he sought a lawyer handle his case

A good friend of mine got a car accident a couple days ago. At night, he was out, and when he about to make a left turn in an intersection, a truck came out from a gas station, bump into his side, making a dent on his side door, and many scratches on the front. From his tone of voice, he sounds pissed since he paid a lot for this car, it is a Toyota Camry, Hybrid. And that person who bumped his car was a Mexican, and my friend just afraid that they got no legal identification, nor insurance either. Luckily, police came, and all the information will be filed in a police report. I told my friend that he should be patient, wait for the police report then he can go after the other party's insurance, and file a claim. I guess he couldn't wait, and he wants to hand over the case to a lawyer to go after them. I think he just overreacting, don't you think?

I've been in a car accident before and I didn't have a perfect mental state after that. I'm in shock for the most part. what I needed is someone who can be on my side. That is where you can be, because he wants to share something and wants your advice on a lot of things. He may be over-reacting or not but also he may not be in a perfect mental state like I was when I had the car accident. Getting a lawyer to handle a case is good but it's not the best option yet. He may incur more expenses on lawyer's fee but if he can afford, then let the lawyer handle the case. The best we did was to settle it outside the court and can be done in your friends case. If the mexican can pay the repair and damages, with additional expenses, then settle it there.

in my understanding of the law, this is a case of negligence. therefore, there is great need that the same be proved against the truck driver. it might cost your friend alot of money at start up to pay for the legal fees, but am certain that once the case is heard and determined in his favor, he will not only be paid for damages on his expensive toyota camry but also general damages as a consequence of the truck driver breach of duty of care for other road users. I advice he gets himself a lawyer.

Yes. I think he is overreacting. I mean that's normal though because it's not really easy being in that situation. But you know if it's allowed in your place, he can do it. Though when there is due process, meaning the procedure should be to wait for the police report before seeking help from a lawyer then he should wait. After all the damage has been done and it it will be proved that it was the fault of the truck driver then he is entitled to be paid for damages.

I think you are right he's been watching too many ambulance chaser commercials. I would contact his insurance agent and get the police report and go from there. Sounds like it's just things that can be easily fixed. In a way I don't blame him especially if it was hard to understand the person who hit him to react that way and assume he didn't have a license amongst other things.

I hope the police will do his job well, not influenced by any bribery. It is always possible that those guilty can made not guilty. If accident happens, for example, a motorbike hit a parked car, the police will normally blame a car owner for causing the accident, which is to you sounds very funny, right?

I think he is doing the right thing. If you just take things in your own hands, the process would take more time. When you leave it to a lawyer, you are also relieved of all the hassles.

He maybe overreacting but I don't know how the system works in your country. After I involved in an accident, the first thing I did was filing the police report. Then I notify my insurance company. The other party refused to cooperate so there's nothing I could do. After that, everything was settled by the insurance company. I didn't even hire a lawyer as the insurance company send their lawyer to represent me.
