New bank fee for cashing a check when you don't have an account with said bank

how can a bank charge you for money that is yours. the check is drawn on said bank, the money is in the account. now they want to charge me to cash it. Is this legal? Do they really think this will fly? I will charge the person writing the check with the fee and see if they tell the bank to take a hike.
I've been cashing checks this way to avoid bad deposit fees and bounced check fees. if the banks think I'm going to pay any fees, they can think again. any info or feedback is appreciated.

I think sometimes the banks can do whatever they want if they don't have the competition. There can be many unreasonable charges because of it. For example, here if I have to check my debit card balance in an ATM from another bank, then it will be charged. Whereas in the past there was not such kind of fee.
